I second this. I am willing to do the same, if and when I finally get any word from B&Q. I understand your fears about misprices but I believe the wording used by B&Q is much more open to question than other websites. If, for instance, it stated the contract to be formed on dispatch of goods I would have accepted their cancellation.0 -
I think this is the key word ' contract ' ,they accepted this contract when then sent the email confirmation and took the monies from the account as per their T/C's of trade.
And of course they advertised the product at a priced! and when this was questioned, they confirmed it!

Ordered mine on Monday - money taken out, got letter this morning. Not happy with their "offer". If they'd bunged in a £10 voucher or something I would let it go but....
I think we should get together and make a complaint with as many of those involved as we can - strength in numbers and all that. What does everyone think?comping since august 2007, wins so far.....none! :rotfl:0 -

Postman late today, but got the letter! I would have been happier if they had offered a nice wooden one of a similar size but an extra 10% what a cheek - and no it was not an OBVIOUS mistake!!

My Dad got his letter this morning as well. Bit disappointed but hey nothing ventured nothing gained!! Lets band together for vouchers £10 - £20 sounds good. What an opportunity B & Q missed if they had sent everyone a voucher we would all have rushed in and bought something... wouldn't we!!

Warning.. following post based on my understanding and may not be correct!The term 'obvious mistake' isn't generally used when it comes to contracts. It is usual either a common(mutual) mistake or a unilateral mistake, where one party alone has a mistaken belief.If it's a mutual mistake where both the buyer and B&Q were mistaken about the price then the contract can only be avoided if it has become impossible. (not true)If it's a unilateral mistake to avoid this contract the party must show:
— it was mistaken as to the terms of the agreement— the other party either knew or should have known of the mistake
— the conduct of the person with actual or assumed knowledge of the mistake was unconscionable.Should we have known about the mistake if the item had a "Big Sale" banner next to it, the saving shown was correct and B&Q are known to reduce items dramatically, particularly for clearance items.The conduct of a person can not be unreasonable if they call up B&Q to check the order with them prior to the funds being taken.0 -
Hi everyone. I've only just joined, however I have been a browser of the site. I wanted to join in with this thread. I've been reading with interest as I placed an order for one at lunchtime on Saturday, received my e-mail confirmation and printed off the receipt at the final stage of ordering. TBH I initially thought, before ordering, it must have been a mis-price. But after seeing they also had another colour (I ordered brown) at the same price I thought it must have been a clearance. How could they possibly make the same mistake twice? Then of course I started reading the stories on here about initial phone calls etc and realised it was (or so they say) an error after all.
Anyway i've been awaiting correspondance from B&Q and this afternoon received my letter, as per what other posters have received. If anything it seems very dismissive, as if to say here's our explanation so thats the end of the matter. They havent even offered any deatails as to who to contact should you wish to discuss the matter with someone at B&Q. Tbh I dont really see the point in wasting the cost of a phonecall to contact them about this, they have obviously heard it over and over by now and no one seems to be getting anywhere. However I did wonder, do you think the BBC Watchdog programme may be interested in taking this up? Obviously enough people would have to contact them with the same complaint for them to take it seriously, but from just the number of people who ordered from this forum I think would be more than enough, let alone any one else who will most likely get in touch too. From there they will know the legal in's and out's and will know whether its something they can fight for us the consumers, or if we dont have a leg to stand on. They will know more than we do anyway. What do you think?
Personally I dont see the point in staging a one-man battle, to anyone who does best of luck to you. But I do agree that how we've been treated is disgusting, terrible customer service and lack of swift contact. They should have at least offered their customers some compensation, better than the pathetic 10% off which they are currently offering. After this, who on earth would take them up on it? Or maybe thats what they are hoping. Perhaps each and every one of us should lol.
Perhaps im in the wrong way of thinking, but if I thought it was going to be backed up with many more complaints then id be more than happy to contact Watchdog with the details I have to see what happens!0 -
