your being choosy with the bits of law you are quoting what you have posted means nothing instead of endlessly discussing on here, I suggest anyone that is serious about this should contact their local trading standards office as anything said on here will be purely speculative0

Not related at all. I ordered Friday night between 6 and 7. Found this site Saturday and lurked for a while watching the posts. I have little experince of legal stuff and certainly not contract law - so more than willing to be corrrected and advised.
However, I have a form in with Trading Standards for my area and will post back with a synopsis of their stance.0 -

Not if it's a small claim (under £5000) - legal costs not recoverable for small claims which means that if you lose then they can't claim their costs against you either. Not difficult to represent yourself though. Court staff will help you fill in the forms (but they can't give you legal advice although the Citizens Advice Bureau might) and the Small Claims Court judges are usually pretty good at guiding you through the hearing, especially if the other side is legally-represented and you're not. The worst case scenario is that you lose the court fee (£108 for a claim worth between £3000 and £5000) and, of course, the time spent and stress of it (if you find that sort of thing stressful). You get the court fee back if you win.0 -

If you are referring to my post a page back from this you will note that the first thing I have posted is the direct link to the whole document. I have only copy/pasted one item which may be relevant to save people having to read the whole document. This is in direct response to the oft quoted WE RESERVE THE RIGHT NOT TO SUPPLY YOU AT OUR DISCRETION.
It might not help anyone get their garden shed/office but it may get this term removed from their website as it definately gives them an unfair advantage If people complain. I will be as I do think that this kind of blanket statement is covered under Unfair contract terms.The victims we know so well

As I suggested earlier if you want to pursue this go and see the trading standrds or a lawyer this happens whenever there is a misprice and no none ever gets anywhere so please no more speculation take it up with a professional0 -
The document linked too is nothing to do with the misprice per se it is purely for unfair terms. Much has been made of the we reserve the right blah blah blah term on B&Q's website so if you think it is unfair, contact the relevent authorities.The link I provided gives the contact details. Like you I have no wish to speculate endlessly on spurious points of law, of which I have no knowledge direct or implied. However I do think like yourself I am entitled to pick up on any points I think are relevent just as you did when you copied the T&C's from the website. I am after all like you entitled to not only hold an opinion but last time I looked I was also entitled to express it!!
I was also under the impression that this being a forum 'discussion' endless or otherwise was actively encouraged!!
I have a personal interest in consumer affairs and have already reported the part I think is unfair. Whether it is or not is up to more knowledgeable people than I.
That said I do agree with your point on speculation and your summary of what normally happens in the 'misprice' arena!!The victims we know so well

I agree, your more than entitled to point out anything at all this forum is for discussion as you said, it seems as always its the quite new members that enter the "lets sue them" stage I think unless any of us have a point of law they are certain on we should all maybe stop speculating as it just seems to muddy the water on these occasions0
