Seems to suggest that the distance selling regs state they should deliver within 30 days (or by agreed date) and if not, ask for a replacement item.
Also talks about 'loss of bargain', which means wemay have to go to small claims court, but B&Q will lose. They may likely have to pay the difference to allow you to buy the product elsewhere if they cannot source replacements.
Either way, B&Q have broken contract law in my opinion and if I don;t get delivery, I'll see them in court (it'll costthem in time and lawyers and they can't excuse themselves from the law).Anger ruins joy, it steals the goodness of my mind. I placed my order on the 20th and had an email confirmation minutes later at 10.01am. I was called an offered a replacement (from BN to MH) I begged the sales guy to let me keep the Ben Nevis and he said he will see what he can do. A few hours later he called to advise he has swapped it with a customer who had been garenteed to Ben and was delighted with their free upgrade to the Matterhorn. So he suggested I was definatly going to get the Ben and would have the delivery call on the Monday!
As we all know I had no call and too date still I have not heard anything. I called them twice last week and was still assured I would be getting the Ben, but I really have given up all hope now. My payment went through on the 20th, I have confirmation from my card company that it is no longer in my account so for 12 days I have paid with no goods recieved.
On another site I visit the unhappy B&Q customers are all rallying to get people to complain to Watchdog, in the vain hope of compensation or fulfilment of the original order. As after all, I belive an order confirmation is a contract!0 -
I ordered the double swing with slide plus the tyre attachment on 19th July. Confirmation sent and payment taken immediately.
I received a phone call and postcard last week to inform me that delivery would take place tomorrow. Just got home from work to find a message on answer machine saing no delivery sorry, contact B&Q direct.
Called and I think I woke some old bloke up as he was the doziest person I have ever spoken to. He said new stock would be arriving within 7-10 days. I asked him was he sure and he said hang on a minute.............. I waited 15 mins and he came back, saying Sorry bad news, call this number for a refund etc.
I will call the other number in the morning, but this is the 2nd time I've been let down by B&Q in as many months. Their customer service is appalling.

Exactly the same has happened to me. Don't give in. We have rights. Someone from Internal customer service team is phoning me back tomorrow, possibly to offer replacement item. They have no right to give such short notice of no stock when they have known about this obviously massive shortage of goods for 2 weeks. They are taking us all for mugs. if we let them get away with it they will.

I got everything bar the uprights, so Its totally useless to me. I have phoned 5 times and emailed and I *think* they are bringing me the missing pieces tomorrow. I don't trust them though- seeing is believing!!

Quick question for both bootman & PhilCCFC. At first yesterday I was told that 56 of the 200 Ben Nevis had been received from the suppliers, then a manager told me that none of the 200 had been received, and people who had been booking delivery dates will be phoned to tell them there is no stock. He assured me that no-one was getting one. No offence meant but I also ordered Monday morning, which was the same day as bootman & before PhilCCFC. Could you therefore keep me updated as to whether you receive a playcentre? Good luck to you if you do, and it will give me more ammunition to prove I have been lied to.

Have just chased B&Q up on my order, only to find we won't be getting any of it because of stock shortages. The lady I spoke to told me that they were told by the manufacturer that they would be getting 500 of each item, but then only received 250 of each. When I asked for a manager, she asked me not to quote her on those figures.
Surprise, surprise, the manager is 'busy' and will be calling me back within the next 20 minutes (give or take a year or two). I am so disgusted with this, it's my daughters 2nd birthday next Monday and I was looking forward to seeing her and her sisters faces when they saw their new 'playground'. I guess I am going to get the 'nothing they can do' speech, and they will literally do nothing whilst we all have to explain to our children why they have nothing to play on in the garden.
I think those of us who have been let down should co-ordinate a plan of action. Anybody got any ideas as to what we should do?0
