    Actually thinking again I would write guess what boring rayday line - a letter of formal complaint that they are not supplying what you asked and paid for if you look at the link below you can pick out list the OFT guidelines they have broken and that is what I would put in my letter

    Hi newlywed - they have 12 working days plus 2 to supply the CCA and then the debt is in dispute.
    After a further 30 days they have committed an offence and then you can report them to Trading standards. The debt remains unenforceable for as long as the creditor fails to produce the signed credit agreement.
    if you want to know about payments then you need to end a S.A.R (subject access request) - this will provide all your payment information where as the CCA request is only for the credit agreement

    Thanks. Isn't that 12 + 2 days after it is delivered or is it after it was sent and just presumed to be delivered?? :confused:

    It's not a huge amount, just that I'm seriously annoyed they've lost about £30 or so worth of payments and no-one will tell me where it is or exactly what monies they received before their system was changed over - seems no-one can look up the old system and confirm having had monies :mad:

    It is against OFT to refuse delivery too so either way they are wrong, I would find a head office address and pen a letter of complaint.

    Thanks - the CCA request letter says about a statement of debt and monies received so thought it was that too. Will throw everything I can at them though as they are being obnoxious and refusing to speak to me "so as to avoid me any stress" :mad:

  • Hi newlywed - the 12 working days plus 2 includes the postage time. They have 12 days and then the 2 days refer to postage time.
    This is the letter I sent which I got off the CAG forum. I think it maybe better to start a new thread so that the DMP thread doesn't get clogged up with other stuff. I would have sent a PM but think it's important that other members can read the info that's being posted - then if there are any obvious mistakes they can jump in.
    Data Protection Act 1998 - Subject Access Request



    Dear Sirs
    Please supply me with all of the personal data that you hold to which I am entitled under the Data Protection Act 1998. In particular, I require a complete list of transactions and charges relating to my history with your organisation. Alternatively, a complete set of statements will be acceptable, copies of all original Consumer Credit Act agreements for each account held in my name, details of all assignments, whether equitable, absolute, legal or otherwise, of the account and documentary evidence of such assignment, details of logic involved in any automated decisions you made about me, or my accounts with you.
    Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or manual notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.
    Please note that this is not an exclusive list, as I require access to all information held by your organisation regarding me, as a Data Subject under the Data Protection Act I enclose the statutory maximum fee of 10 pounds. You have 40 days in which to comply. For the purpose of identification, please see the attached sheet for other names and addresses I have used in the last three years, along with my account details.

    sorry ive just got back online but just wanted to say thank you so much for that info


    can i just ask another question, what reason did you give for goin diy and were the cccs funny with you for cancelling? im just really scared of rocking the boat but feel i could have a couple of the smaller debts at least payed off by the end of the year if i take control back.

    the cccs sacked me - at the time i was upset but now I'm glad they gave me the push - so I didn't need a reason.
    I think just tell them you are now in a position to deal with your creditors yourself. They will still support you if you need their help or advice.
