Do your creditors send you letters directly saying they've agreed to the DMP/freeze interest? I've not had any info from the creditors or CCCS yet and it's been about 2 weeks (I know I'm impatient
)
Also the CCCS website has a Mange Your DMP section. Call me stupid but I can't find out how to register for it? There's nothing in the welcome pack they sent me even mentioning it :rotfl:0 -
Hi CBI, I have been with PP since the end of January when my first payment went out to my creditors. I have only heard from M&S so far to say they agreed the offer so phoned PP myself the other day and they told me the creditors who have accepted. The post has just tumbled through the letter box (I am no longer afraid) so might get more updates now. If you're worried just phone PP. I will be phoning them tomorrow when I have more time. Take care, you have done the right thing.0

CBI - two told me they accepted (one by phone, one by letter) the rest stayed very very quiet, and kept charging interest - until they sent a default notice and then stopped charges and just heard nothing at all from them at allworking on clearing the clutterDo I want the stuff or the space?0

AmyV, the creditor will go for a CCJ & Charging order & you don't have to default for it to be granted. They can't however go for an order of sale unless you default on a CCJ. I know this to be 100% true because I'm in the middle of fighting a charge at the moment. Whether HFC will be granted the charge will be totally down to the judge on the day but national debtline, CCCS & Citizens advice have all said it's pretty much a foregone conclusion because the judges just grant them these days so the companies can secure the debt.
Re- Abbey, I am currently dealing with the Abbey Debt management side of the company & they have been brilliant with regards the DMP. I have had no hassle at all from them.
One final thing, as negative as this will sound (& I only saying it to warn people), don't believe that because a company accepts the DMP thats the end of the matter. To my complete surprise this morning I got a threatning letter from Goldfish Credit Card, I phoned them to see what the problem was to be met by an arrogant bloke who said they have sold the debt on. They done this despite sending me a letter in sept '07 accepting the DMP payments until Sept '08. I haven't defaulted so you can imagine my surprise & horror at this. I'm now waiting for Cabot (the DCA they have sold it to) to get in touch & see how much in charges they have added to the debt!!
Sorry to be so negative on this one but thought everyone had a right to know exactly what can happen!!:j DMP mutual support thread member - 135:j0 -

Some creditors send letters direct to you, others send them to CCCS & some don't bother at all.
Regarding the website I had the same problem, they sent me my username but no password. It took 15 calls & 5 months for them to eventually send one to me.
If its any help to you use telephone number 0113-297-0133 to contact CCCS rather than the 0845 number as its much cheaper or even free depending on your telephone talk plan.:j DMP mutual support thread member - 135:j0 -

Hi Geoffmr
I don't understand this because on the HM Courts service - in their info to Creditors it states
"
You can apply at any time after you have obtained judgment. However, the judge who considers your application will not make an order unless the judgment debtor:- has failed to pay the amount of the judgment when it was due; or
- has failed to pay one or more of the instalments due under the terms of the judgment. "

Thank you to Marru and Sam89. Your advice did wonders. Sadly HSBC would not cancel the direct debit when I phoned. Now wishing I had internet banking so I may have been able to do that myelf. but I have yet to hear from them - I am sure they will be on the ball tomorrow though. But I am ready for them.
Typically due to stress and work getting in the way today I didnt phone Lloyds but it is on my list of things to do first thing tomorrow that and calling Payplan to make sure that they did actually receieve my paperwork.
Here is hoping that things look a little more organised tomorrow!
Thanks again.0 -

Hi,
Sorry just to clarify. Do you bank with HSBC meaning that the account from where the DD is going out is that in HSBC if not then call you own bank and cancel the DD in your own bank. That way you won't accumulate bank charges in your own bank from HSBC trying to take money from there. If you do bank with HSBC then just ignore what I just said. I just read what I wrote, good luck if it makes any sense to you.

AmyV,
If your creditor gets a "forthwith" judgement he can go for a charging order. If you cant pay, apply for an instalment order and the judge will usually reduce the payment to an affordable monthly one.You will need to produce your latest I/E statement and a list of your creditors together with the monthly payments you are making each creditor.
Good luck0 -
Posted on this thread for the first time yesterday making out how fine and dandy things have been for me on my DMP for the last two years, when i get home today to my Halifax CC statement and find the have charged me interest, and overlimit fees totalling £35! I then got out my January statement and sure enough, interest etc added to that too ( i should have checked that one closer when i got it!)
I started my DMP in Dec 05 so two years later they decide to start charging me again - is this normal for Halifax? I have emailed Payplan and will call Halifax tomorrow to find out what's going on.... I only pay just under a fiver to them each month so my debt with them is going to spiral at that rate!
Oh well, more phone calls to make....
That'll teach me for being so sure everything was running smoothly!0
