    hi everyone,, hope you are well

    me still trying to do this dmp myself, and now im finding that as ive changed my mobile number and i dont answer the house phone if its 0845 0800 or 0870 starting, they are now asking me to call them,,,,i don t think so....lol

    So back to reply to them to ask me what they want to discuss with me they can put in writing to me.

    i m awaiting for rma and vantedge to supply me with the cca on both the mbna accounts have now passed the 12 days and thus will wait for the other 30 then will write to mbna directly cc these other 2 muppets individually and say they have breached the law and take the next steps there on.

    i think im going to ask the next muppet on my list bank of scotland and halifax for their cca and see what happens to them , they refuse to stop the interest and though its their perogative, im never going to get the debt down,

    what a nightmare, but im still hanging in there.

    Hi all, just wondering about a few things, hope you can help.
    I spoke to lady at CCCS yesterday who said my DMP was due to start today. I haven't recieved any paperwork yet so i don't have the slip to make the first payment at the post office. Is there any need to worry yet or wait a few days.
    I was also noticing that a lot of people have been asking there cc firms for a copy of their cca. Can someone tell me why they are needed and would i need to ask for mine and why please.

    Good morning boys and girls, hope there is lots of sunshine where you are today. I've actually put washing out on the line :D

    I got an email from CCCS yesterday enquiring as to whether I still wanted to do the DMP because they had not received the paperwork back. I havent received anything through. So, I've rang them this morning (they are such lovely people) and the guy I spoke to said it looked on the system as though there had been an error and the pack had not actually come out to me. So they are going to make sure I get one this time :j

    Lostalot - why not give them another quick call and just check to see whether yours was sent out. CCCS told me it should arrive within a couple of days - rather than a few weeks which is how long I have been waiting. I'm not sure about the CCA points but I think (dont quote me though) what some people may be doing in the event that they are having a difficult time from their creditor is requesting the Consumer Credit Agreement (CCA) in relation to that debt. If the creditor cannot produce a signed copy of the original agreement then the debt MAY be unenforceable and therefore unrecoverable by the creditor. There is another thread somewhere on here that goes into it in more detail and would be able to help you understand it more.

    Carlos - yours in an interesting post and I too would like to see how others are managing their money once on a DMP. Mine hasnt started yet :rolleyes: but I am hoping that in time it will mean that we are able to go and buy clothes or have a hair cut completely GUILT FREE! I would love to have that feeling of having everything that should be paid, paid and then still having some pennies left to be able to either spend or save (however small a sum). I would say try not to feel guilty about your spending (especially as everything else has been paid) and stick to the "do I/family NEED XYZ or do I/family just WANT it" mantra. I'm learning a lot about the difference between needing and wanting things. Enjoy your new clothes :D

    Sam - [don't worry about the defaults, they're just bits of paper! :p] - Thanks for that comment - I'm going to engrave that into my brain to try and repeat every time I feel low about the situation we are in. I'm trying to stay positive because we are actually taking steps to deal with the situation rather than try to ignore (we all know it just doesnt go away!), so thank you. I need to remember that someone somewhere is just doing their job and not to take it too personally. I just need to learn to erase the word "failure" from my brain and then I'm all sorted :rotfl:

    I'm getting worried.... :)

    I sent my forms off to Payplan last week, and sent off token payments to all my creditors except one which I forgot about until I started typing this! All DDs are transferred to my new account, pay will be going into this as of this month too.

    I havent heard a word from any of my creditors :confused: They all cashed the cheques I sent straight away so I know they've had them, but I haven't heard a thing from any of them. I'm going home in a few minutes though so I bet there will be a pile of papers waiting for me! The peace and quiet on the phone front has been good, too.

    I know it won't last as I'm sure some of them will start to hassle me soon but at least I can now pass them onto Payplan. It feels quite a relief to have done this and to be able to start dealing with this :T

    Hi Tishywish, we're now 9 months into our DMP and there are some of our creditors who I have NEVER had any correspondence from, but when statements come in they show 0% interest :D . At the end of the day that is all we are asking for, to be given a chance to pay what we owe without them adding on crazy levels of interest and charges. There are others who phoned but just quote your DMP number and they seem to mostly leave you alone. Our only real hassle was GE Money.

    Sunshine, Glad I helped, at the beginning I was really stressed by the thought of defaults but the excellent advice on here changed my attitude to them. It's not like they are ruining my credit rating...it's shot to pieces anyway :rolleyes: .

    I've spoken to CCCS and can pay up til the 10th and should be able to use debti card at PO so will do that this afternoon.

    Just realised re-reading yesterday's post that when I said "brasserie I go to a lot" obviously I meant USED to go to a lot!:rotfl: I'm not lying honest - it's around the corner from where I used to work (job before the one i just got fired from) so we did go in quite a lot - not so much now, but did meet girlfriends there on Tuesday which is how I found out about the job, but only spent £14.00 which I thought was ok.

    Carlos, I'm a bit like you at the moment. There certainly isn't a complete embargo on spending money in this house, but is is under control and within the budget. Our budget is actually quite generous I think, but I am trying to spend as little as poss at the moment obviously. So don't feel guilty if you buy a new top or two - I think it is very hard for most of us to go "cold turkey" overnight. But as already said, do try to distinguish between "want" and "need". We do all "need" a little treat sometimes, but not every week. Mmm, very sensible advice but maybe I need to practice what I preach a little more... :D

    Ive just recived the information through the post from cccs and hadnt realised they set the figure there and then from what you put online! Ive got a couple of dilemmas now.
    1. I think my tax credits will be stopped soon and they are a big chunk of the dmp payment (£172 of a £335 payment!) Wont it be a hassle cccs sorting out payments to our creditors only for them to have to be reduced a lot in a month or so?
    2. I get my tax credits weekly but our first dmp payment is due 1st june. How will i give them the tax credit money if i dont have it yet?!
    I thought about saving the next 4 weeks but we had a lot of high bills this month and i need it for the weekly food top up/public transport.
    3. I pay provident weekly out of my tax credits too, do i stop paying them now and contact them with a token payment or just keep paying them weekly until the dmp starts?
    Thanks for any help, hopefully i can send the information back to cccs today or tomorrow :)
    Well, called and asked this but apparently we have to 'try and find the money somehow' and we've got until the 10th june to find it. :confused:
    Called tax credits to see if tax credits would be stopped, the answer was it will probably stay the same but we need to ring back with ohs p60s fom 06 and 07? We're sure he wasnt sent any for those years but the lady was very snotty so we couldnt be bothered talking anymore...:rolleyes:

    Lloyds have instructed solicitors from whom we received a letter today, stating if we don't pay in full, they will issue Court Proceedings.

    Now, here is a funny tale ... OH's account with the aforementioned Lloyds has always been in the wrong name, i.e, they have incorrectly spelt his surname on everything, including the original credit card. Apparently he wrote to them about this a couple of years ago but they have never changed it to the correct spelling.

    I was wondering, what could the legal implications of this be, if any? ie., how are they going to register a Default on his credit reference file if the name is incorrect? And what about a Claim Form, etc and Letter Before Action?

    Just wondering if anyone would know? Obviously, he will have to tell them again that the name is wrong but I am curious now as to what could happen.

    Anyway, I hope everyone is okay and looking forward to the long weekend. We hope to do a car boot sale on Monday, weather permitting, as we have a load of junk that hopefully people will be fighting over to purchase!

    Hi whoopiedoodle. Interesting question and I was in a similiar situation a few years ago. However, when I took legal advice the solictor said that because I'd used the account for quite a while with numerous transactions, then I was admitting that it was my account, irrespective of the bank spelling my name or otherwise. I used it, so , it must be mine. You might have better luck.
