How does that work then? I thought that my NR loan would work out that way, as the contractual payments are quite low, but CCCS told me that you would NEVER pay an amount equal to or more than the contractual payment on the DMP and surely if they are getting more than their fare share it is not fair on the other creditors and they could still kick off?
PS Not wanting to rain on your parade by the way, but having a bit of a rayday child feet stamping, it's not fair moment! If my payments had been worked out that way then I wouldn't be facing a charging order! But actually as I type I think I've just sussed the difference between us - you are presumably paying the same rate as your mortgage, whilst mine is 10.49% so the payments are that much higher - I think they would be at least 1/3rd less if I was on normal mortgage rate - that's probably why your payment has worked out differently.
I guess it's the proportion of this loan compared to the others. The NR loan is over 26k and the rest of them put together are 31k so that's how the NR loan gets such a lot.0 -
Today is the first day I've properly realised the meaning of being on a DMP.
My car is poorly - possibly terminally and I can't afford a new one, and no way of getting credit to replace it.
Unfortunately I can't do without a car as work is 25 miles away and public transport is non existent as is cycling as I'm petrified of traffic.
I've asked my mum to look at our budget to see if we can trim it even further so that we can try to save a little bit if it does die.
Just as we were getting straight after 9 months maternity leave and DH changing from weekly to monthly pay too!

I've decided that I am determind to stay with DMP rather than IVA or BR...unless a creditor makes me BR.
If I enter into an IVA Ill be stuck with that payment for 5 yrs.....and if I defaulted would be made bankrupt......with my health record I don't think its a good idea.....also with the present financial climate who knows whats round the corner.
Still worried about 1st Credit and their threats of legal action, but am not going to let them bully me anymore.....I know the debts are my own fault..but I haven't ignored them I've dealt with them in the best way I felt was possible.0 -

im back for your kind help again and welcome to HollyB - this is fab thread ensure you subscribe to it and if you have time have a good flick through promise you will learn so much.
My dilemma guys, ive got the nasty mbna i have 3 accs with them 1. mbna card, 2 mbna virgin 3 alliance and leicester mbna
all 3 accounts received letters from them today, all from the same team and manager head of customer assistance.
my questions are
1 ref all letters, they are asking me to contact them on freephone number to discuss the available options.
I have already supplied the income and expenditure and have paid them on 28.03.08 and 23.04.08 the pro rata payments done via the national debtline site.
i have cca'd both mbna and mbna virgin, as they had put rma and global vantedge to chase me for the debts.
Thus im awaiting on the cca for those 2 cards and to see if they default.
From the advice already given to me from an earlier post in the week, i think i should just write to them now advising them i have written to them with my letter and income /expenditure letter and that im vunerable and am off ill under a consultant and am willing to correspond only by letter and not telephone so there is always someone that can help with my correspondence. I feel this way i can explain that ive paid the pro rata payments so far and to correspond only via letter to me and for me to reply by letter back.
Oh by the way mbna virgin also wrote that a restriction is on the account and to return cut up credit card and any cheques to them.
Im happy to send this card back, dont ever intend to use it again and will not be using any of of my credit cards again on my dmp.
im also thinking of sending a seperate letter for each account or should i send them all on 1 letter since its the same team corresponding with me, also what about charges ive had, i wish to claim those now too to offset against the debt would be good.
What do you all think?

Could you send one envelope but with 3 individual letters with relevant card names on them just so there is no misunderstanding on there part?
And yes go ahead with the request to correspond in writing only and you could always put again in that letter what there pro rata offer is and even another expenditure sheet - I think I send thousands of them out whilst getting all my companies to agree.
I think if you have requested CCA you should too point out that they are not supposed to correspond with you until they have supplied what you asked for - definatley shouldnt put pressure on you - but maybe you want to check that out with a CCA expert.0 -

However, remember ive cca the debt collection people who were chasing me for the debt on behalf of mbna, i know what you are saying not sure if i should put that in my letter ive not heard a peep from the 2 companies who chased me until i sent the cca, now only mbna chasing me, Sorry i perhaps didnt make myself clear on my above post,

id second rayday, what ive learnt in the past month its amazing, i was this scared rabbit at the end of march but now i feel so much more aware of a lot of stuff, im not scared anymore.
This site and cag are fantastic, i would just advise to read as many appropiate posts and threads you can to learn about others problems, and you may find the strength to continue this fight in a more prepared manner.
Pls dont let anyone bully you im so proud that i actually changed my mobile and got a new number, ive got caller id on the house phone so no more speaking with anyone i dont want to . The relief is fab, and i wouldnt have got as far as i have if it wasnt for the great people on here.
So please ask away any concerns and questions you have - someone will always guide or help

Hmm hang on my brain works slow at night.
They were passed onto a DCA and you CCA them - is that right?
But you got a letter from MBNA again in your last post so they are back being handled by MBNA? - if that is the case don't mention the CCA and wait to see what happens but do send the DCA the reminder letter thingy.
Sorry I am very sketchy on CCA so maybe take my words with a pinch of salt!0 -

i rang national debtiline about who to send the cca and they informed me to send to rma and global vantedge who had written to me asking for payment on behalf of mbna.
Sent them last week, thus next week will be the 12 days so im thinking to not say anything to mbna just to acknowledge mbna letters received today and about liasing with me by letter and me with them in writing only. I really do not want to speak with them, as then i wont have any record of what was arranged agreed discussed, and not really mentally quick at the moment, im better writing things at my pace.
will still send the rma and global reminder letter thought after the 12 days
