  • morning everyone... I finally managed to get to speak to the CCCS about my reduction in pay and was told they need the actual pay slip not the letter of appointment (which is what I was told last time!) However as I have reduced cash flow and increase car payment (to cover arrears) they have dropped my payment to £50 for the next three months by which time I will have my new pay slips and a better idea of what I am spending on fuel etc! I know that if I had sorted this out on my own I would never have got my creditors to agree to that!! lol!

    But I did get a letter from MBNA cc saying payment plan 0% interest etc as long as you keep that payment.. then two days later, dated after the first one saying you are in arrears we will default you if balance not cleared in 7 days! So I'm ignoring it lol! They are all going to go mad when they realise I've had to drop my payments and I may well end up defaulting but tbh my credit file is so bad it won't make much difference lol! and maybe the dca's will be easier for CCCS to deal with! Who knows!

    I agree with you Tara. I phoned CCCS yesteray and I am sure that when the lovely lady i spoke to saw how much in debt we are, she must have been wondering why I'm not suicidal!

    I'm just not a big worrier by nature and you never know what tomorrow will bring - it could be a CCJ, or it could be that premium bond that you forgot all about (don't actually have any of those tho...:D ). I joked to a friend about this the other day, when I worry about how much I am drinking, I just pour another glass of wine, when I worry about my weight, I just eat something nice to comfort myself and when I worry about money, i go and buy something to cheer myself up - OR in the case of the latter, I DID DO THIS BUY DON'T ANY MORE:j This is partly because now I am starting DMP (also 1 May) I am not so worried about money any more. Just need to work on ways to cut down the food and wine intake !;)

    The point is that we are all doing the responsible thing in paying the money back, so there is no point in beating yourself about it or worrying yourself to death about it, it won't make any difference to how things pan out anyway.

    I went down the CCA request route with Lowell because from the start of my debt troubles they have been truly horrible. To cut a long story short;
    I sent the request letter, they didn't respond.
    I sent the letter about them breaking the law, they send me a copy of my short application form (with a short statement about the CCA, NOT the CCA).
    I sent them a letter telling them that what they sent me wasn't a CCA, and set out for them what one should look like (!).
    Today I receive a termination notice telling me that my account has been passed on to their legal department awaiting litigation.
    What do I do?!?!?!? I'm in a bit of a panic now.

    Hi ailsajayne27, The whole world of CCA's, SAR's, is quite complex but, like any other subject becomes simpler when you get into it. I've found a site which is part of the Consumer Forums web site, tited "Inside a DCA". Its a bit heavy on the old grey cells but, will give anyone who wants to know more about DCA's and CCA's a deep insight into how it all ticks.

    Just a quick update have been on the phone to churchwood this morning and have asked for them to tell me how much i owe now and how long i have got left to pay as they never actually told me!!!.
    They are going to write to each of my creditors for balances and are going to let me know as we are going to start offering more payments and start to pay off odd bits off the cards one by one.
    We are also getting a mortgage pig as from the mortgage forums to put extra money off the mortgage too.
    Thanks for all the great advice so far.

    I have discovered that having a set day every week and a set amount each time going on the gas and elec prepay meters is working out much better for us budget wise. Didn't run out of either all last month - which is very unusual as I always seem to forget to check them!

    Also not done too badly this week - had a £10 voucher as sainsbugs order was late £10 voucher due to some issues with the stuff delivered, plus got £20 credited to my account by vodafone because they had network issues and my mobile wouldn't work and I spent over half an hour on hold waiting for customer services (from home phone) and they still didn't answer - so I sent a stroppy email saying if I can't even talk to your company then I'm going to look elsewhere ;)

    And I've just done a favour for someone and been offered a bottle of wine :D

    Got car tax and MOT at the end of this month though, so it won't last :(

    It's basically a copy of the credit agreement you sign when you take out a form of credit, companies sometimes get rid of them, lose them and they are meant to keep them. Wouldn't help with an OD I don't think.

    I want ours as a test, then I'll go back through all statements and claim back charges, I reckon there's £300 there since the start of 2007, I haven't even worked out all the late payments that occurred before that (am sure there's loads, dad was awful for posting cheques at the last minute!).
