Anyone having trouble with Egg ppi reclaiming?

Hi there,
i'm trying to reclaim my ppi from egg on the grounds that it was a single based premium, and i was in a fully secure job in the civil service and didn't need the cover.
I have twice written to them now, and they say i have no case and they will not enter into any further communication with me
I originally took out the loan in 2004, and then when i was struggling with my credit card, asked to take a payment break from the loan. They managed to persuade me to take a new loan out instead to repay the original, and add my credit card on top. I was told this was a totally new loan, but now they're saying it was topped up (even though the agreement number is different)
They're arguing the case that i had all the information, which i had to read through and sign before i sent it back.
I'm a bit stumped now, do you think its wise to take it to the ombudsman based on their argument?
Sorry if this post doesn't make sense, i'm a bit annoyed right now!

I've just started trying to reclaim. They've dismissed my first attempt with "you had all the information" bla de bla. So Ive said I don't have ANY paperwork at all from Egg and to send me all the details pertinent to me opening the account. Which isnt a fib - I don't and I keep EVERYTHING. Its an Egg Card. To be honest I cant even remember what YEAR I signed up for it so I cant even do the sums of what to claim for yet. So I'll wait to see what they say. Then I might just get down and dirty - use one of the templates. Let me know how you get on.0

thanks for your reply, i'll let you know.
well i've sent off some forms to the ombudsman, so i'll see what happens, i suppose you don't get anything if you don't try!
Will maybe dig my egg card stuff out later, but come to think of it I don't think i have got any paperwork about it either.
How did you request your paperwork through?96 items decluttered so far in 20130 -
Well I asked online but they just gave me a link to their exiting policy but I signed up in 2002 - it wasnt the paperwork I originally signed. So do I take their word for it? (yeah right) I actually do have a thyroid condition and when you read the T&Cs it says ANY pre-existing condition - which is very sweeping. As the thyroid affects everything in your body, they could, if Id claimed, dodge paying out quite easily. So Ive written back telling them I can provide them with a copy of my prescription. As there was no discussion and they can't come up with the paperwork- pay up or Im off to the authorities. Watch this space.0

I've sent two letters to Egg asking for the PPI insurance to be refunded. They are not upholding my complaint and have referred me to the ombusdman.
Its a hard one because I filled my application out online and they claim I would have been presented with a yes/no option and that I selected yes and would have had to read and accepted the terms and conditions before I could have proceeded. I had no reason to take out protection for a credit card and so I'm wondering if this protection section was ticked as a default.
I'm gonna read up on the ombudsman and see what I can do from there.0 -
Hi
I am in exactly the same situation as the OP; topped up loan (which they said was a new loan) to pay off the credit card. Now on my second letter to them and am requesting a copy of the tape which they say was taken when I got the loan in the first place. I also have a pre-existing medical condition which they did not ask about, but they have said that I had all the paperwork and a 30 day cool off period. But I am going to persue this. Have asked EGG to cancel my PPI and take it off my payments, am wondering if I should have asked them to take it off the term of my loan, any advice?

Ive successfully, and with no argument, removed PPI from all three cards I hold and a loan with RBS. The latter reduced the amount I owe the bank and has reduced my monthly payments too. I can't see how Egg could refuse to cancel it from this point - except they all have a 30 day notice thing - which I can see their point there. I did organise two policies first though. One loan repayment insurance for £27.50 and Income Protection to cover the credit card repayments for £12. As I say Im not an expert, I can only tell you of my own experience. I think if you can prove you hold adequate insurance of your own for the amount you owe Egg, they can't really NOT cancel the PPI from that point. Whether it was applied throughout the period of your loan or an upfront one-off (I don't know) but if it was spread out - then the final amount you owe Egg will certainly reduce - I think. My loan has.0

They now have a company wide policy of refunding such claims, it has been found that around 90% of people who complain about ppi are having their claims upheld. Go back to them again if you have been rejected. Besides if you write more than 3x they will cave in if not first time round0

This is very interesting... I had an loan from Egg in 2001 which i was charged over £200 PPI (which I dont remember asking for..)... i then took out a second loan with them in 2003 they made a huge !!!! up with the whole thing... and again I was sold PPI... this time i remember the sales person was very persistent... I went into the application firmly thinking I was going to take it out... and after a verbal battering I had agreed to it...even though I didnt need it.... this second PPI was almost £1000.... making a total of £1200+ in PPI payments that i made and didnt need to!
The problem is my loans started in 2001 and 2003... so finished in 2008(ish) so I'm not sure if they will be counted!... I'm keeping my fingers crossed and writing a letter today!0 -
I to have had the same rejectiong from Egg card. Saying the boxed was ticked by me. I have looked into cases where between 2000 and 2003, people who signed up online, did in fact have a pre-ticked box.
This letter was written to them by another member,
Dear Sirs,
Account number: xxxxx
I refer to my complaint with regards to the mis-sold insurance opened with my account.
Obviously you are now aware of the outcome of the recent high court ruling with regards to miss-selling of PPI insurance, and it has also come to my notice from well known consumer internet forums that in 2002 when I applied for the account online the insurance box was pre-selected and had to be un-selected by the customer if it were to be not required.
I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again. If I do not receive a more favourable response from you within 14 days I will not hesitate in taking my complaint to the Financial Ombudsman Service which may result in legal action being sought as part of the process.
Yours faithfully
AND GUESS WHAT!!! they had a full refund of over £2600 within weeks WITHOUT going FOS. This is my next step, let me know if anyone has success

Mine was taken in May-2002 and ran until Sep-2005, and so I am expecting a couple of £100 + 8% etc0
