  • Well if illegally recording someone to get what is legally yours, I dont see a problem. Theft is more illegal then recording someone to get what is legally theirs. If the OP wants to contact the OFT and TS and tell them so they can look into it. So it does not happen to anyone else.

    If that was me I'd say sod the legality and send the tape to everyone that can do something about this shops attitude

    It's illegal to record anyone without their knowledge or permission - that's tape recording, cctv, whatever, and as such these recordings can't be used as legal evidence in court etc. Informing the person after you've made the recording makes no difference, you MUST inform them at the beginning of the recording and if they refuse permission, then you must cease recording immediately . Also, you need permission from the people before you broadcast any recording, so putting the tape on You Tube really isn't a good idea. However, what the OP did seems to have scared the bejeezus out of the shop staff and, assuming that there are no other issues here, it'd be a really good idea to send the tape to H&B's head office, although from what others have said this rudeness seems to be company policy so I'm not sure if it'd achieve anything .... Keep a copy of the recording thgouh ;)

    I've no idea how Rogue Traders get away with it but I'd imagine that they've got a fairly hefty legal department behind them advising them how they can avoid being sued for defamation of character etc. Lets face it, a dodgy plumber/builder who's already facing legal action isn't going to take a TV programme to court over being filmed, that'd be dumb and I bet that's the premise the programmes work on ...

    I believe it's not illegal for an individual to record a conversation. However, it cannot be used in court as evidence, or published (eg on Youtube) or disclosed to a third party without permission.

    As sarah said it's perfectly legal to record a conversation without the other person's knowledge. The conditions are that you are a participant of the conversation (e.g. you can't bug a meeting you aren't in) and the recording is for your own personal use (i.e. you can't divulge the recording to third parties which includes courts and hence they aren't admissable without other participants' permission). Even the chief of police does it. So there's no law being broken by simply going in and recording a conversation you have with anyone and not telling them you're recording.

    Holland and Barrett try very hard to tell their staff to check the customer's medical history and not to reconmend EPO for epileptics, anything to anyone pregnant or on medication, etc but there are always going to be assistants who forget or ignore warnings. H&B in the north east used to have great customer service but now there's a high staff turnover and the assistants just don't seem to care.

  • To be fair, they get that kind of fraud quite often. Someone finds a till receipt, goes into a shop, steals something, damages it, and then takes it back to get a replacement.

  • I've also witnessed a sales assistant in one branch recommending Clary Sage oil to help with a lady's depression. Nothing wrong with that, but the lady was heavily pregnant and Clary Sage is to be avoided during pregnancy as it can induce contractions. Very worrying.

    I see what you are saying but lots of people use Clary Sage oil in the bath during the lst 3-2 weeks of pregnancy to start themselves off . I used EPO to induce myself , worked a treat , my waters broke within the hour !
    Baby Thomas born 3 months early by emergency section on 21/1/09 weighing 1lb 15ozs .
    Thomas came home after 3 months and 2 days in hospital weighing 5lb 15ozs
    Thomas weighed 21lb 4ozs on his 1st birthday , a total weight gain of 18lbs 5ozs !
