hi i really need some urgent advice...im thinking of leaving my husband..hes abusive and very emotionally draining. he has not been a good husband or father to our toddler.
i have to leave him for our good..however i have no idea on what happens in a divorce im very clueless. we have a home with both our names however he pays the entire mortgage payments. what could i be entitled to? we been married 6yrs and have a small child. if he knew i wanted to leave him he would throw me out penniless...im so scared.
any advice appreciated

Just wanted to send you hugs and also to say get yourself to citizens advice as soon as possible.
They should hopefully be able to give you specific advice about your situation.0 -
If you are in any immediate danger, pack a bag, take your child and leave now. Courts do not tollerate domestic violence (I watched my mother being physically attacked for 20yrs by her now ex husband), but right now the safety of your child and of yourself are paramount.Debt free since 2014 - now saving for a mortgage deposit :heart2:

As Miss Kitty says speak to the CAB before doing anything.
i think you would be entitled to 60% of the house as you have a child to look after. You are entitled to some of the house as your name is on the house regardless of who has paid the mortgage.
If he throws you out the council will provide you with emergency housing.
have you got a close friend you could confide in and set up an emergency plan just in case anything happens?
if you have a car, get some of your essential documents and an overnight bag packed in the car just in case.

thanks for replying.....i feel i cant leave i have no money of my own and why should he get everything iv invested my life into that home.just want an idea of what im entitled to coz hes gna play dirty0

get yourself to see a lawyer and womans aid thing wont change i left my husband 23 years ago with 3 kids under 5 i wont lie it wasnt easy but i have never regretted it married again with 13 year old son good luck to you0

if you are on a low income the cab will help with things like solicitors etc... i think.

if you are not working you wil get legal aid i think anyway the 1st consultation is free just check with them i had a lady lawyer and she was fab0
