its not like i dont know where they are so if worst comes to worst ill get my money back another way

If the timing belt hasn't failed but needs replacing due to mileage that's something you should've checked before purchase, it's not an MOT fail or fit for purpose issue, just lack of routine maintenance.
As for the MOT, nobody should ever buy a 12 year old banger without insisting on a new MOT, especially with the last one being 10 months ago.
Your best hope is they take it back and refund you less the cost of the damage you caused with your inattentive manoeuvring in their yard.0 -

I'm not sure why you came here if all you wanted was for people to tell you what you want to hear. What you've had is good advice that will pre-warn you of the potential resistance/objections you're likely to face from the seller or in court. Giving it the "big man" act isn't going to impress any of us, especially when your username is "fuzzycat"😀

mechanic came out and is giving a full report, diagnostics indicative of cat failing and that they definitely knew about it

It's a pity you didn't engage this mechanic before purchase. He sounds brilliant, being able to do a full inspection and diagnosis in the last 23 minutes! Where did you find him?

sorry how am I the bad guy here?
just to recap since buying the car on the 18th of april I've had:- a fault within literal hours of sale
- emissions + engine faults
- failed repair attempt
- all while i've driven the car literally 100 miles… are we really defending these people?

You are not the bad guy, you just bought a 12 year old heap of junk without doing any due diligence and now have buyer's remorse.

Don't see anybody defending them but throwing 'I know where he lives' makes the whole question asking pointless.

You seem more intent on arguing with people trying to advise you than you are acknowledging your own failings in this situation and how you might best overcome them.
Giving it the whole "I know where to find them" tough-guy routine makes you a good guy, does it? It just suggests you're out of your depth.
I suggest you start again, accept that you came here knowing less than the people trying to help you, and take their advice on board. Otherwise, what was the point of asking? You may as well just tell us you've had a full refund, kept the car and got a hamper to boot if it makes you feel better, it makes no difference to anyone here.
You may have a case to reject the car, but you are likely to face lots of resistance, much of it justified.

whilst the mechanic may have identified a fault - proving that someone knew about it might be a touch more challenging
