What about using acc and sort code to set up direct debit?

I have written thousands of cheques over the years and every one has my account number and sort code on it.
I think the assistant in M&S did absolutely the right thing. Imagine a random kid had found or stolen your card and tried to use it.

Maybe you should send an email to M&S, asking them to thank the assistant for being so diligent as to keep hold of a card that was obviously not being used by the owner.

What is the problem here except the OP's misuse of their own credit card by giving it to someone else to use.
So yes the fraud was by the OP

It was a debit card, not a credit card.
OP did not commit fraud by giving card to someone else, but almost certainly broke the bank’s T&C.
Must say I’m surprised by OP’s reaction and questions though.2 -
Yes, giving your debit card to someone else—even with permission—is generally considered a violation of your bank's terms and conditions, often deemed unauthorized use. While not always criminally prosecuted if permission was given, it is considered fraud by banks, which can lead to denied reimbursement for losses and potential account closure.
Matter of viewpoint or wording what each bank would call it I suggest

They'd also need your address (your name was presumably on the card), and the Direct Debit guarantee would reimburse you for a fraudulently set up DD.
If all you needed was the SCAN then accepting payment via bank transfer would be very risky (as you have to tell the person paying you your details)

Setting up a DD is a facility that can only be granted by a bank, and they will only give this access to bona fide businesses that bank with them.
A bad person could use the details on your card (or cheque) to request DD payments from your account to a legitimate third party (they would need your address) but you would be notified of any such arrangement being requested and if it ever took money fraudulently like this then the DD guarantee will reimburse you.

It's possible they could use the details, but you'd be protected by the direct debit guarantee.
If you'd found someone rifling through your bag or something then you'd be right to be suspicious, but these seem like quite innocent circumstances.
