I received a small claims form and have completed the aos and gave till 31st to defend.
but states vehicle exceeded maximum stay and on the alternative the D is pursued as keeper under ppfa 2012 for £170( total amount is £275

I was on complete shock to receive this as I did visit to buy my mum a new battery for her car. She gave me cash and it was so long ago I don’t have a receipt .

I look after my mum who has rescue animals no phone or internet and is 85 and needs help with them and managing her finances and shopping ( no internet banking or buying online) but also suffers from a adrenal fatigue due to low dhea which means that I have limited time that my energy levels are better and to get things done thereby I can manage my mums life effectively but the more I do for her the less o do for myself and late 24early 25 I became so ill with something causing sweats coughing non stop weight loss and couldn’t even get to dr to tell them that I couldn’t get anything done let alone get anywhere on time . But I was always late and got turned away so it was about 6 months later I finally got antibiotics and help .

By then I was already in trouble with my own housework piling up and not checking mail as exhausted and things just continued when my cat started yowling every other hour through night and was vomiting blood and then I couldn’t get him any help and was going to vet to vet to vet and again was so exhausted I could easily have missed the letters .

Eventually this year I got my cat help he needed and was told had landlords inspection in a week and in a mad panic just threw everything out because I wasn’t expecting anything other than statements in post as have everything on d/d so can manage my disability and not miss payments .

Unfortunately I’ve now got this a council tax liability order and am defending myself in consumer affairs small claims against unscrupulous tradesperson .
so I’m at wits end

I do remember going there and that I couldn’t decide which battery was best and waiting to get help from someone and the. Going back to the car in car park to ask someone I knew which to get . In the end I went back and bought one.

im not good at managing time or getting things done in a timely manner because I have limited time to get things done in a day just few hours for myself where I can.
mistakes were made diagnosing my illness originally although dwp have just assessed my illness and found in my favour with all evidence that they now have and can I and how do I get this from them to defend myself in the claim as I have this disability .

I don’t own car anymore it was sold for scrap .
I spoke to the parking attendant when I was in the car taking a moment as I wasn’t feeling that well ( this was start of that illness and I kept getting periods of nausea ) and he came over and I was speaking on phone and I asked him to please give me a moment as I didn’t feel well . I phoned to speak to the person who voluntarily helps me look after my mums animals ( 15 rescue cats and 11 rescue horses) to let them know I was on my way but wasn’t feeling well was just taking a minute and felt sure I had cleared with attendant. The car park wasn’t full at any time and there was plenty of spaces (as was between 2 and 3 pm.
do I put any of those on my case defence ?
And how is it best worded ? I guess it’s in para 3

There is no parking fee it’s free but I didn’t take any notice of signage or notice it till I went back few weeks ago and was directed to it. I always thought as I drove past the back of it the sign was for Halfords store .
it’s really high up and sun can make it hard to read sometimes but as parking man is there and I knew store had time limit on staying and as had indicated to him I wasn’t feeling well ..

I can’t say if any notices were sent to me but I don’t remember seeing any at all . It was a shock but I was the driver and keeper .
im struggling a bit to make sense of what bits to use etc because I have so little time to sit and read it and reading can make me tired as it mimics ten eye movements ( hence read a book to go to sleep ) so I gave to keep walking away and coming back to it and am running out of time to get this done . But I’m worried about understanding some of the arguments to make my defence verbally if necessary. .
sorry to be a pain I used to have support worker but my landlord moved me to an area where the service is not offered . Hence why o have got into so much trouble when things got tough last year .
it’s not that I’m not reading it all more that I’m struggling to

What is the date of issue of the claim form; it is shown at the top right of the form. What does it state in the POC part way down on left hand side. When did you submit the AoS? Did you try complaining to Halfords?

I went in person to Halfords first in Gravesend as it was closer and then went to Halfords in Chatham

I have written a rather long complaint email to Harry Burch ceo Halfords and resolutions centre at Halfords but have not sent them yet although my friends said even though it’s long all of it is true and if I edit it it will take forever so I should just send it as it is . Bit so far I haven’t because I was told by managers at both stores it happened too long ago and they wouldn’t be able to help if it is subject to court proceedings .

i m also getting confused as to how the Beavis case applies to me I was reading about it on piston heads and it didn’t seem to apply to my circumstances . . If at all .

Your defence deadline is 4pm on Tuesday 7th April, so around 10 days time, meaning that you need to make your defence submission a priority

I doubt that Halfords are the landowner, more likely to be a tenant

The Beavis case applies to ALL parking company cases, in various ways, including signage, landowner authority, the additional fictional debt recovery charges, POFA2012 etc

With an issue date of 03/03/26 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 07/04/26

Your paragraph 3 will just be a couple of sentences.

1. Were you having the battery fitted to the car?
2. Am I right in thinking you left and returned? Was this on the same day? Was it a short time before returning?

And don't worry. 99% of DCB Legal cases are discontinued.

Thank you so much for your replies . I do get that Bea is applies to many different aspects. Even though he lost.
it was such a long time ago I emailed them for the evidence and particulars of the case but not heard back but I might have emailed the wrong people should I email total parking or DCB?
I also read that they don’t send back any info even if you request it .
mum now confused because I think when I went on 14 th March to speak to the store about this ( when I received the papers ) and they directed me to the signage outside it was just one large billboard with its back to a busy road held high up on metal posts . I was sure I read it was only 30 minutes . But my friend went today and the signage looks new and she didn’t see one large sign just small signs on the walls and I was round the side and the small signs are behind me . The car I had then had very tinted black back windows and rear windows and I wouldn’t have seen them anyway but they say 60 minutes now .
on the 14 th I just snapped a pic of the car park owners ( not very well ) as I was so shocked as this was first o had heard of it . So I’ve got a snap of solutions Ltd . And part of the address at bottom of sign. My friend went to take pictures of all signs there today and they do seem new .
if I did leave car park it would never have been without permission from the attendant but I think I waited to hear from my friend about which battery to buy . He took half an hour to answer me.
as I don’t have any particulars other than what was on the form i can’t say because other than using my phone to see messages and calls I took to ascertain what I did on that day which I’ve established I was there to buy a battery for my mums car and I did ask which battery and yes the store didn’t have anyone much to help because I bought one with terminals round wrong way in some form or another which my friend was able to make fit some how. So I didn’t need to take it back . But it wasn’t specifically right one but was one that Halfords said was an option !

no I didn’t have the battery fitted I went to buy one for my mums car but took my own car to do so ( hers being totally dead )
