  • I've had a response from the court after emailing asking them to strike out my hearing as UPKS failed to pay the Court fee on time.

The reapinse says its been reinstated after a determination by the judge, and to appeal I would need to submit a n244 form.

I don't have the funds to do that.

I have no other adult available to come and supervised my son, and have asked for permission for my baby to come into the court room with me, but they've responded saying he can stay in the waiting room with a supervising adult.

At thia stage, would be it better to contact moorside legal and make a payment that would be less than the costs they're seeking to recover?

No. You are entitled to attend and entitled to justice.

Go, and take the baby in with you.

  • Thank you @Coupon-mad

Can they refuse to let me enter the court room if I have my baby with me? Will the hearing go ahead in my absence should this happen? I'm trying to prepare myself on what to expect. Given the judge decided to reinstate the hearing despite the C breaching the deadline, I'm not feeling very confident at all

  • So I have submitted a N244 form and ex160. I am hoping my pittance SMP qualifies for exception from paying the application form.

I called the national contact centre and asked for specifics. The original notice of hearing was dated 6th October with court hearing fee to be paid by 9th December. The Court issued a 7 day deadline, but the payment wasn't actually made until 29th Januray. I then received a letter saying it's been reinstated for 18th January.

I am hoping they process the forms in the morning, and the hearing is set aside. I will also be attending with my baby in tow.

  • Extended Deadline * so new payment deadline of 16th Decemeber.

Brilliant! Well done you and baby!

    ANOTHER ONE BITES THE DUST!

    😃

P.S. did the C not send any legal rep?

  • Nope, no one from their side attended. Just me, the Judge and someone from the court observing - not sure who they were but they sat beside the judge
