  • I did miss a trick, certainly.

When you say submit them this week, is thay in advance of the hearing scheduled for 18th? I thought I would request costs at the end of hearing if/when I win. Do the costs need to be submitted to court beforehand?

Yes you should. A week before is good.

In my first ever case where I lay repped at Worthing Court, the defendant had only put their costs assessment in on the Friday, and the hearing was the following Tuesday. We won hands down but the lovely lady judge decided not to award his costs because she felt that the C had not had sufficient notice.

He nearly got a grand, as there was wholly unreasonable conduct and he should have got costs on the indemnity basis. He wasn't awarded any costs.

  • Please can I ask how I submit this info to the court? Is there an official form? Or would I just provide a typed breakdown of indemnity charges, sign and date and email in? Or would it have to be posted/hand delivered?

Yes, with the claim number & hearing date/time in the subject line. Sent to the local court by email (not CNBC) and cc in the solicitors for the Claimant.

It's not just your costs sheet.

Don't forget the skeleton argument and the two transcripts that you missed submitting. Copy some paragraphs from other threads by searching for:

A skelly doesn't have a statement of truth but needs your name & date at the bottom.

Email to court and copy in the lawyers

  • Thank you, would that be considered an amended WS with the additional paragraphs?

Neither. It's a skelly and (effectively) I already said it's not a WS because I said:

"A skelly doesn't have a statement of truth but needs your name & date at the bottom."

Told you what to search for, too!

  • Got it, thanks. Would I write it in the first person, or refer to myself as "the defendant"? Ive found a template to adapt so will share it here before emailing tomorrow

The defendant. But a skelly is just about the case law you are showing to the judge, it is not your story again.
