Moorside Legal Claim - Feb 2026 [Claim Dismissed]

Basically what is says in the title! After 6+ years of battling through a PCN with UKPS Ltd, I am due to appear in Court in January after not coming to an agreement with mediation. 
I have recently given birth, I'm breastfeeding and my court summons states I need to be prepared to have 6 hours in the court between 10am and 4pm. It's not feasible with a newborn and quite frankly I don't want to interrupt his feeding schedule.
Am I able to delay the hearing? Is there a process I can follow to request for it to be postponed?

    You can apply for an ajournement, how depends on the court but most are sympathetic to new mothers so long as you provide evidence such as birth certificate.

    Which solicitor firm? Most discontinue cases and no hearing ever happens.

    Thanks. I am planning to request adjournment based on needing to breastfeed still. Do they tend to discontinue close to the hearing? I have submitted mt witness statement and they have also submitted theirs

    They tend to discontinue just before the hearing fee is due to be paid,  so check with the court just after the deadline date 

    You can certainly ask the court for a new court date,  but it may cost you money and not be worth it,  but the EA2010 may allow you reasonable adjustment,  or a more certain time,  like say first on the list

    You can also send a notice to the court as per the relevant CPR to advise of your non attendance, at least 7 days notice required.  27.9

  • Thanks all for the advise. I've contacted the Civil Court Centre and been advised that adjournment requests will cost either £313 full price without the Claimants consent, £123 with the Claimant's consent, or free with consent 14 days before (I did ask for clarification if that was more than 14 days, or within 14 days, and the advisor couldnt advise, she simply said it states 14 days).

    14 days exactly prior to my hearing is Christmas Day.

    Paying isn't feasible on statutory maternity pay. 

    Would requesting consent from Moorside give them ammunition to continue? Really hoping this nonsense is all dropped

    What date is the hearing fee deadline date   ?
