I don't understand the appeal process
I attempted to trace the landowner but the local shop and the head office refused to tell me/didn't know. It's a parking eye car park.
I am appealing and I read here that I should appeal as keeper, not driver. There is a tick-box saying:
I confirm I have attached all supporting information available to me, and understand that I will be unable to provide any additional evidence at a later date, unless specifically requested by Parkingeye. I don't want to tick that as I hope to be able to get evidence that the sign isn't illuminated during the night but I haven't been able to stay up that late since. (I'm old!) Should I wait and try again to get that picture before doing the appeal? How long do I have before I can appeal? It happened on 25th September. Charge issued 29th. Thank you |

The appeal to Parking Eye WILL be rejected what ever you put and you don't need to send them photos of anything, but get dated photos when you can to show the existing conditions for later on.There is already a first stage appeal written for you in the newbies thread, don't worry about that rubbish from Parking Eye.3

28 days is the appeal deadline, so you need to be appealing ASAP, regardless of any pictures
If the NTK PCN letter complies with POFA 2012, by comparing yours against the 2 examples in the newbies sticky thread in announcements near the top of the forum, appeal as driver, if true, mentioning the poor illumination on the signs etc
Tell us the exact location
Take a picture of the front of the pcn, after hiding your VRM details and the reference number and your name and address too, so no personal information, but leaving all the dates and times showing, plus add a picture of the rear of the pcn too

POPLA response: "I am satisfied that the signage is clear and visible and it has been audited and approved by the BPA. Signage does not have to be lit and car headlights are sufficient to highlight signage on entry."
When have you ever seen a private car parking sign with its own overhanging light in a local shop car park?
Keep your photos and save them for a county court claim, where it'll either be discontinued or you can submit your photos.5 -

If it's B & M , Winsford, there will be a landowner and a landlord for that shop or retail park, so complain to the retail park management company or landlord or landowner ASAP too4 Dingle Walk, Winsford Cross Shopping CentreWinsford Cross is the only shopping centre in Winsford and dominates the in-town retail provision.Key tenants represented include New Look, Boots,Argos, Greggs, Home Bargains and B&M.
B & M will be tenants only, so probably didn't employ Parking Eye, but somebody did, possibly Barker Proudlove ?

The shop is Home Bargains. I think there was a B&M there at one point. I haven't been to this car park before.

I asked TJ Morris who owned the land but they didn't tell me. The store staff didn't know - they thought it was parking eye but I think they don't own any of the car parks they manage.2

Also, I have had a 'parking charge notice reminder'. Is that my 'notice to keeper', as per this section of the newbies thread:
"Postal PCN from a BPA or IPC member ? (i.e. with no mention of any windscreen ticket):
A postal PCN or NTK might be headed up 'Reminder' or 'Charge Notice' or it may even be a letter from a debt collector - it is your Notice to Keeper, in effect, if it's the first letter to arrive. No need to wait, appeal online as registered keeper (or as ''hirer/lessee'' if that's the case, see * below re lease/hire cars)."
Apart from 'reminder' it looks to me to be exactly the same as the original letter and was issued 8th Oct. Thanks0 -
OK, but still a private retail park owned by a landowner and tenanted by shops and businesses, at least 5 businesses including Home Bargains
Its not owned by Parking Eye, the shops and businesses have no control over the private parking company, Parking Eye, hence why you want to complain about it to the retail park management company or landlord or landowner, not the tenants like Home Bargains
I would suggest that their was no parking contract on offer at that time of night, just forbidding badly illuminated signage
No offer, no consideration, no parking contract, ergo the driver was trespassing late at night
