  • I believe I'm being fined for not registering at parking space and not for non-payment of parking space . Is that justified? 

    My situation is similar to being parked at LIDL. At the store if you forget to scan your shopping bill to validate your stay you get a parking ticket but if you have the proof of purchase it is at least considered and the charge is cancelled.

    its not a fine, the Lidl and ALDI  i use have no requirement to scan anything other than your shopping at a self scan till

    It isn't a fine and you won't have to pay a penny even if you lose this appeal.

    But I can see you didn't tick 'OTHER' and didn't use the resources in post 3 of the NEWBIES thread about POPLA.  Nobody is advised to tick 'I didn't see the signs'.

    You could not register as you wasn't a guest of the hotel, and you couldn't pay as there is no parking during the times you were on site.
    There is no fine as we keep saying this is a commercial contract which you could not enter in to for the above reasons, there was no offer, there could be no acceptance, so there is no consideration.
    John Lewis cannot sell you a TV after 5PM on a Sunday in store, you cannot walk out with it, you cannot be expected to pay for what you cannot buy.

    I was browsing TVs in my local John Lewis store (St James, Edinburgh) yesterday evening at 5:30pm. They were quite eager to sell me one.

    However I agree that the OP had no option to enter into a contract with the landowner (OP's contract with Geniepoint is only for purchase of electricity) so there could be no contract to breach.

    @Alderbank Yesterday was Monday not Sunday, and Sunday trading laws don't apply in Scotland

    Are you resident in Scotland?  -  has the driver been outed in any correspondence?

    Since my local store is in the St James quarter of Edinburgh it's a fairly safe bet that I'm resident in Scotland.

    Parking is expensive in that part of the capital so I usually jump on the bus. I don't know anything about the driver.
