PCN - Napier Parking at Station Hill , Chippenham

If you look back through this thread you will see the images I sent to Napier re this same carpark - the one in Sainsbury's colours/ livery points to the Pay& Display car park to the right which is not even theirs! With a large 45 mins for Free Sains sign this could easily be interpreted that if you intend to stay longer then park to the right and get a pay & display ticket.MNrhubarb said:Update to mine. They have photos of my daughter getting into the car, so they are alleging that I was there to pick someone up, which is true.I have stated that I was not parked, as I never got out of the car. And the photos show that at the entrance to the car park there is a great big sign that says 45 mins free. Their signs are all small and thrown onto a lamppost. They did reply to my appeal with the IAC and uploaded not only the images of my car in a bay with my daughter getting in, but also their signs in PDF format.I replied that they failed to show the positioning or size of those signs.I have not heard anything from the IAC since. I presume the adjudicator will decide. I would be surprised if they rule against me seeing as they have upheld recent appeals on the same grounds, but you never know.
Napier have sent me images of all their signage to show that they have 'sufficient signage' but this is not the point. Sains also have signage and between the two sets of signage this creates a degree of confusion to the driver as there is no clear demarcation between the two car parks.
If you enter as a Sains customer your immediate impression is that you can park for 45 mins free. They can't argue that you didn't get out of the car and read and fathom out the signage because you would only do that if you were confused. The confusion only lands when you get a ticket and you then realise there are two carparks!
The fact that your daughter was getting into the car is irrelevant in my opinion - I know you said you were picking her up but she may have popped into Sainsbury's for all they know! It's none of their business.0 -
Thanks. Yes I did upload the pictures of the HUGE sign at the front of the carpark.Napier have not responded to my update and neither have the IAS.I am fully prepared to have them take this to court. There has been a law change recently which means that all claims under £10k I think it is, has to have mediation before going to court - this is to try and deal with the huge court backlog. I doubt very much Napier Parking will attend any mediation.I won't pay at all. Thanks for the advice. I'll let you know how it goes.1

Just to update. I have not heard back from the adjudicator or Napier parking. It's been a month now, is there a time limit on these things for them to respond before the case is closed?I have heard from the local MP who has said she will contact Napier. Might be worth giving her your details too @lily10 ?2

I've heard nothing since either- date of my 'offence' was back in August; no contact since September.MNrhubarb said:Just to update. I have not heard back from the adjudicator or Napier parking. My MP is not Chippenham as I don't live there but I passed all the details to my own MP who said he would liaise with your MP (can't remember her name) to try and sort things out at this carpark.1
