You need to show your evidence and tell your experience to the Government because one of the questions is about whether cases like this should see a PCN cancelled.
Of course it should be cancelled in future! This wasn't something you did. It was app autofill.
These mitigating circumstances cases MUST be cancelled in future - and if we can persuade the Government.to ban these PCNs and ban Debt Recovery fees then those decisions will help you, if you ever need to defend a claim.Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline.

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.
Ordinary people like you are falling victim to this scam over 18 million times per annum. Motorists need your voice added please.

Thanks for the reply Gr1pr.To clarify, I didn't think the debt recovery agency would be doing that, they threaten that their client the parking company might apply for this, see attached image.

The pink bit is lying.
Nobody can 'apply for' a CCJ and nor can a party 'start legal proceedings at any time' because there is a pre-action protocol and they have to send a LBC or LoC first.
I asked about the date on the letter because you've no doubt read the NEWBIES thread and spotted from the pics in post 4 of it:

- I've noticed a further irony in that Trace operate a policy with regards to 'unattributed payment'. "If a customer later shows us proof that they made an unattributed payment, we will apply it correctly or refund the customer". This is essentially what happened in the first instance with the parking company. I paid for parking but it wasn't attributed correctly, I proved I had paid them but this didn't satisfy them, so here I am being threatened that I now owe £340. It's absolutely criminal they can operate like this and needs to stop.

If a DRA can 'apply' an unattributed payment correctly and retrospectively, then so can a PPC. Any trader with a customer service ethic would do that and not charge £20 'admin' to accept the payment their system failed to either pick up or correct on the spot, if apps and ANPR worked properly in synch.
After all, the BPA is in charge of apps with the NPP project. They can make it fair if they can be bothered. They won't unless the Government force their hand by not making these cases worthwhile for their members.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
