DCB LEGAL CLAIM FORM

PLEASE HELP;

After ignoring numerous letters from Euro Car Parks and subsequently DCB Legal I have today received a Claim Form. I am determined not to pay BUT this forum and its chaotic nature is making is nearly impossible to understand.

The date on the Claim Form is 13/5/2025 asking for the sum of £270.64

I have managed to submit online my AoS following the instructions on the Newbie thread.

Now I am completely stuck and confused by the defence building. 

Just to be clear I have no good reason for not paying other than me completely missing the signage to pay for parking via phone. I am not the registered I was leasing the car at the time and no longer lease he car. The car was a personal lease under my name which is the correct nameon the Claim Form.

my main questions are:
1) How much of the defence letter template actually needs editing by me?
2) Why is there a WTS link underneath that post and do I need to use it?
3) Where do I need to send the email defence to? Direct to DCBL or to the Claimresponse email?
4) Where on earth is this illusive para.3 by 'Shahib' do i need it and where do I put it??

I appreciate this forum is here to help but I must say it is next level when it comes to confusion.

    Use the Template Defence.

    Put this as para 3 (see below) UNLESS YOU HAVE SOMETHING IMPORTANT AND CASE-SPECIFIC TO ALSO SAY, SUCH AS BEING A BLUE BADGE HOLDER (RETAIL PARK SITE?) OR THAT IT WAS TWO VISITS IN 24 HOURS, NOT ONE, OR WHATEVER?

    3.  Referring to the quantum in the POC: the claimed sum is hugely exaggerated (no PC can be £170 on private land and interest cannot accrue on that inflated total) and there were no damages incurred whatsoever. Regarding the pleaded case: Paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraphs 2, 3 and 4 are also denied. To the Defendant's knowledge, there was no contravention and any purported terms on signs were likely inadequate. The Claimant is to put strict proof of all of their allegations. The Defendant is not liable and has seen no evidence of a breach of prominent terms.

    4. (rest of the template defence - para 4 onwards - goes here but pleease don't show us the entire template).


    Job done, once emailed as per the easy first 12 steps in the Template Defence first post.

    With a Claim Issue Date of 13th May, and having filed an Acknowledgment of Service('AOS') on 15th May, you have until 4pm on Thursday 12th June 2025 to file a Defence.

    That's four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.

    Thank you for your reply, Do I need to edit the template defence statement much? My wife was with me in the vehicle and she is a blue badge holder. Also, where do i send the email? Thanks again

    Only alter paragraph 2 with a short ending and use the supplied paragraph 3 above in place of the existing paragraph 3, the rest are unchanged,  but add your case details and personal information etc too. All 30 paragraphs will be used,  ALL , save the final defence document as a pdf document,  attach it to the email 

    The email address is in the first post in the defence template thread in announcements,  plus in the 12 steps you need to follow contain it,  its the claim responses address at this stage

    I suggest that you carefully study those 2 posts in the defence template thread,  to absorb the process and contents

    The Defendant's wife would have accompanied the Defendant on any visit to this site and she is a blue badge holder. As a matter of law (Equality Act 2010) service users and their carers are legally protected from the effects of detrimental, fixed terms & conditions.

    Hey again! Ok, I think im about to submit my defence, I have followed guidance above and added the sentence regarding the fact my wife was with me and has a blue badge. I have also read through the 12 steps to get it clear in my head.

    quick question. does the letter of defence begin with IN THE COUNTY COURT or do i need to change that to IN THE CIVIL NATIONAL BUSINESS CENTRE like it says on my claim form?

    @Coupon-mad Thank you. Can I ask for some advice or at least for your opinion on something?

    I submitted my defence via email following the directions in the first 12 steps guide and definitely received the acknowledgement email from the CNBC. That email also said that I will hear back from them within 10 days. I did not hear anything via mail or email until today 23rd June and that was in the form of this letter:

    I haven't had any directions questionnaire from the CNBC, I dont even know what/who the 'mediator' is as everything seems to just be so quiet and non-eventful.    Am I missing something??
