Hi all,
we have just got back from being away for three weeks to we have a PCN from Civil Enforcement for charging our ev at CO-OP Clacton, 162-164 Old Road, Clacton-on-sea. We only used the charger then left the car park (did not use the shop). Should we pay the £100?

1) What do the signs state ? ( VRM registration inside the shop ? )
2) What do the EV provider state or say when you complained ?
3) What did the Co-op or landowner say when you complained to them ?
4) What is the contravention described as on the NTK PCN letter ?
5) Does that NTK PCN letter comply with Pofa 2012 ?
Nobody on here is going to tell you to pay !2 -
This is the only evidence we have (from bank statement). We were charging for 33 minutes.0

Post a redacted picture of the NTK PCN letter
See the questions I asked too2 -
Unfortunately we cannot remember what the sign said and cannot get to it as it’s miles from where I live.
We haven’t complained to either ev provider or coop/landowner as just got back from being away from home.
unfortunately our understanding of these is very limited.

Not enough information provided, plus the picture is not all of the NTK PCN letter ( suitably redacted by hiding the name and address, the vrm details and the reference number first ) , so you haven't shown us the other details required, nor answered every question, 5 were asked , 4 and 5 weren't answered
Need more information, but no personal or private or sensitive information !
So here in Google maps

The signs face towards the parking area, ask the co-op to take pictures and email them to you2 -
Unfortunately I do not understand questions 4 and 5. (Even after a little research). Sorry0

Post a picture of the back of the pcn, because no contravention is showing on the front
4) they will have or should have listed what the contravention ( reason ) was that caused the NTK PCN letter to be sent ( what they would call a breach of the parking contract on that private property )
5) the law that transfers liability from driver to keeper, as explained in the newbies sticky thread in announcements near the top of the forum by coupon mad3 -
So sorry for being so thick but have never dealt with these before.
Thank you so much for being patient with me.0 -
Looking at the pictures, there is no indication of what the driver did or didn't do , the alleged contravention, or breach
They are asking for money without telling anyone what rule the driver may have breached, what the contravention was
Had the driver been speeding at 39mph in a 20mph zone, the NIP would mention the reason for the speeding notice, ie, they would know what the charge was
To check on POFA compliance or not, you compare your pcn against the pictures provided by coupon mad in her newbies sticky thread in announcements1 -
Thank you so much for your help. Unfortunately I cannot see a newbies sticky thread or announcements but I’ll keep looking.0
