Hello! 

Thanks to all that have complied the NEWBIE thread. I have read the NEWBIE thread and am overwhelmed with the info offered.

At this point I cannot see the wheat from the chaff in terms of my particular 'offence' which I categorise as extortion.

On 18th March, 4 days after the alleged 'contravention' I received a parking charge letter from UK Parking Control by post.

My *offence* ~ 'Not parked correctly within the markings of the bay or space' in a free-to-park, retail park in Waltham Abbey, Essex.

Landowner is Legal & General Asset Management as shown by a plate on a building.

No address - only a phone number. I have researched online but no joy.

The photo shows my vehicle parked in 1 of 2 'bays' separated by 1 hached marking.

One of the rear wheels 3 inches into that hatched marking in the disabled bay, which to all intents and purposes in my mind *is* part of the bay?

My Blue Badge was on display.

I had suffered a medical emergency and needed to exit the car quickly. I was driven home by a relative, in her car. 

My car was collected less than 30 minutes later so there was no overstaying.

I disputed the charges on receipt of the postal charge letter, (18th March 2025), and explained what had happened via email. That I had suffered a medical emergency, had displayed my Blue Badge at all times and had been driven home by a relative and my car had not overstayed the 2.5 hour limit.

On Good Friday, 18th April I received an email demanding "medical evidence for the date of the contravention".

I have been back, (19th April), to photograph the signage, the disabled bays and spoken to store managers about UKPC predatory conduct. 

With reference to UKPC outrageous demand for "medical evidence", I would assert that in order to obtain a Blue Badge I have already established, with proof, my disability and it is most certainly not within their, (UKPC), powers to decide this.

Moreover, it is a gross breach of my right to privacy. As a disabled person, I have protected characteristics under the Equality Act 2010 and failing to make reasonable adjustments, (ie. the need to park differently due to my condition) is a breach of those protected characteristics which amounts to a criminal offence by Legal & General and their sub-contracted agents, UKPC.

Can they make this disgraceful demand for "medical evidence in relation to the date of the contravention?" 

Could you please offer advice on the best way to proceed?

I will add that I have read, re-read and read again the NEWBIE thread and am still at a loss at how to proceed as my circumstances/situation appears unique?

Any and all advice would be very welcome. 

I cannot and will not pay £100 on a point of principle, (reduced to £60), you know the 'deal'...

    If you want them to offer a concession for obstructing the hatched area, that is for the use of both bays (which they are not obliged to do without good reason), you will need to evidence why you feel you should get one.

    It's just an invoice. They can ask for anything they want and you are under no obligation to provide it. You could provide evidence your leg fell off and there is nothing to actually compel them to cancel their invoice.

    They are not obligated to do anything and sucking up to gain a "concession" is an odd approach.

    If it did go to court, you could ask the person who provided assistance to provide a witness statement. 

    A DCB Legal court claim and eleventh hour discontinuance is the most likely scenario whatever you do though.

    There no logic to follow such advice.

    If the operator is offering the opportunity for a concession if you provide evidence to support your claim (they can’t just take your word for it), just provide the evidence to avoid all the messing about post claim form addressing points that could just be actioned now.

    And which parking firm do you work for...
    To the OP this poster works for a parking firm. 
    Like most of the parking world they hide being mailing addresses.

    I see this all the time here SB. Motorists looking for advice and all they are told by activists to ignore everything except a claim form or LBC, when they could have just put it to bed quickly by following the appeals process and either have the charge cancelled or pay £20 and move on.

    Not everyone has the time or desire to play games with parking operators.

    Maybe it’s a marketing ploy to drum up advocacy work 🤷🏼‍♂️

    Come on so you honestly believe someone should have to provide evidence of a medical emergency on that day. That is beyond the pale
    If they had a heart attack or a epileptic fit would you honestly expect proof to be provided
    Asking for proof of payment of such like is a different matter.

    To the OP you should maybe ask the landowner to cancel this charge. They have a direct portal with UKPC for doing this. It's as per the standard contract that UKPC issue.

    They should simply ask the landowner /managing agent to instruct the parking operator to cancel the charge
    Job done. No payment required.
