URGENT HELP SON DISCIPLINARY MEETING

    It could be that the employer wishes to have a disciplinary and make the son realise how seriously they take comments from the public and that they will be investigated.

    Might get a verbal warning or perhaps nothing will come of it?


    We have been thinking that too.  My sons line manager has said other people have been reported for worse and nothing happened to them.  
    Apart from the fact that the line manager shouldn't be discussing other members of staff it really doesn't matter what has happened in previous cases.  (Unless there is any discrimination involved which would have an impact on your son)

    I think there could be discrimination involved.  But cant ve proven.    It's such a hard situation to be in.    No names were mentioned my his manager just that in the passed others have done worse.

    Maybe this is an "official" meeting as in official feedback and turn out to be a "Look, SonnyJim, when you're out in one of the cars you're representing us as a company and so you have to be an absolute angel.  Someone is saying you weren't but it's only their word against yours with nothing to back it up.  So I'm just going to note this on your file and we'll get back to work.  But rest assured if someone else reports something the consequences could be much worse!!"

    I think there is a lot of info here that is misleading.

    You say you have been trying to make your son go to the doctors to get diagnosed for 'years'. Yet he is only 19 now.  If he has been having anxiety and panic attacks at work it begs the question why they are letting him take an expensive vehicle on the road

    You say - This is based on a customer calling his place of work and reporting him for fast and aggressive driving.   Which he says he was not doing.

    No speed limits were broken.

    He was driving an m4 BMW in the wet

     When he was in a flow.of traffic doing 60.

    He wasn't doing 60 coming off the round about.  This was approaching it.  With the flow of traffic.    

    If he was in flow of traffic approaching a roundabout doing 60mph then he is lucky not to have a fine as well. Traffic does not approach a roundabout at 60mph.  Then you  say he was coming off a roundabout?

    Why was he driving at 60mph in the wet on an A  or B road?
    I think you need to take what your son is saying with a little bit larger pinch of salt. He cannot say he was doing 60 approaching or coming off a roundabout in the wet and then also say he was not driving either fast or aggressively,. It just does not make sense.

    He needs   to be contrite when he goes to the meeting. If he starts throwing the words 'Disability' and 'Discrimination' around it wont help. If he genuinely has a disability then he needs to get properly diagnosed. Anyone can claim disability and fitting the criteria on line is not a definitive proof.

    And maybe he can go prepared to say "Look, I don't think I was doing anything wrong but obviously this is serious and I really don't want to lose my job.  I know better now that when I'm out driving one of the cars I represent the company and I'm going to extra careful that I don't do anything that would cause anyone to take special notice of me."  

    Sometimes going in humble can work wonders.

    If your son hasn't previously declared a disability to the employer, then he is on shaky ground now claiming a disability
    A disability can occur at anytime.   Undiagnosed adhd and autism are still disabilities even if not confirmed by a doctor.    A person can chose not to get a formal diagnosis and clearly have a disability.    

    Anxiety and panic attacks are disabilities and he has had them witnessed at work in the past.   But not confirmed by a doctor


      His line manager had to calm him out of a panic attack when he was told about this report against him using distraction techniques.
    Well then clearly his employer knows about his panic attack disability.

    There is alot of confusions in the case.

    He was driving with the flow of traffic on an a road between two roundabout with a 60mph speed limit. 

    Obviously he slowed down when approaching the roundabout and he was going right round it to come off at the last exit. 

    When coming off the last exit we think this is where the complainant saw him, they were coming down a hill to join the roundabout
     
    My son was the lead car coming off the roundabout  and accelerated to the speed limit of then 40mph.    Maybe the sound and quickness of the car made it look fast and aggressive to one person but would not to someone else.  

    This is my problem.  Without any actual footage of the event it is one person's opinion over a other. 

    It's quite hard to get all the facts from the other person's complaint when we only have a paragraph in the letter with the managers comments about the complaint and what he said was said in the meeting with my son.   

    The letter does state possible gross misconduct for possibly bringing the Company into dispute and in bold letters that a possible outcome could be summary dismissal. 

    We have not been given all the facts from the complaint in writing.  

    Hence why I am posting in here,  as it seems they have already made their mind up.   

    It's not right for anyone to go through this without factual evidence and just based on someone's opinion and perspective.

    In employment law an employer does not have to prove something happened, just have a reasonable belief it did, and believing one person over another is common. So if the manager believes he did drive carelessly, aggressively or anything else that is enough.

    given he has less than 2 years employment and could just be told don't come back, he is lucky they are following a process.

    it still doesn't make sense to me, on top of previous points/ queries I'm not aware of any bmw dealers that are so far away from a petrol station you need to drive at 60mph to get there.

    Sorry, but as has been previously mentioned, with under 2 years service, your son can be dismissed without reason. May appear unfair, but not unlawful.

    It is a bypass road around a town which is about a mile long on the a66 which is a national speed limit road.  Between two roundabouts.
