Parking Eye Defence

Hey there, I have received 2 letters from Parking Eye for payment of £100 on a private casino car park. Straight after this I got a claim form in the post from the courts. I feel this is was an unfair attempt from PE whereby they didnt even send a pre action letter signed by a solicitor. What could be a valid defence? Appreciate any help. I am scared of getting a CCJ. Car was there for 16 minutes and they’re asking for £210. £125 for parking £50 solicitor and £35 court fees

    1. Do not pay
    2. Read the newbees thread
    3. Complain to the landowner ( casino? ) ask them to get the ppc to cancel
    4. Do not admit to being the driver
    5. Check your V5 - have they sent other letters to an old address?
    6. You will not get a CCJ unless: 1. You go to court, 2. you lose in court, 3. you fail to pay after losing in court within 28 days.

    Hey thanks for your response. I have been to the casino they tried to remove it but it said they cant since it had gone to the legal stage already?

    Does responding to the claim form as a defence mean I will be going to court? Or should I just pay the £210 to avoid a CCJ.

    you won't get a ccj unless you lose in court - and only then IF you don't pay what is awarded within 28 days.

    you may not even get to court - if it ends up with DCBL chances are they will fold before it gets there - there are 500 recorded cases of them backing down on this site alone with many many more

    Your LBCCC may have come direct from ParkingEye, they have their own litigation team.
    This is mentioned in NEWBIES post 2 Small Claim section which you need to read.

    PE can't have £125 for the pcn unless it says that on their car park sign.

    Post copy of the claim form after reading IMPORTANT info in yellow box at the top of page. Remember to redact your password too.

    So an in house claim by Parking Eye 

    What is the issue date on the claim form,  top right   ?

    Not all claims get to court,  if it did and if you lost,  you get 30 days grace period to pay the judgment figure to the claimant, meaning that there would be NO CCJ recorded

    A claim filed doesn't always mean you'll have to attend court. PE might discontinue.
    Lots of written info in the Announcements threads and posters to help you defend the claim.
