I have just received another message on MCOL which is as follows:
"Your claim was transferred to ST. HELENS on 07/04/2025"
"The Claim has been transferred to another court. You cannot respond to the claim online anymore."0 -
Is this your local court as its the local court for the claimant
Or is the defendant a business.3 -

Not local to me at all as I'm in Kent. I'm not a business.ChirpyChicken said:Is this your local court as its the local court for the claimant

Right so it's been allocated to the claimants court by mistake.
So send an email to st helens County court
Schedule the email to send next Monday
Tell them it's being allocated to the wrong court and as per civil procedure rules it should be allocated to xx court. Ask them to place thus email with the paper work for the judge to them reallocate to xx court
It should then get allocated to xx court for a hearing3 -
When you say xx court do you have a specific court in mind or is it up to me to choose a local court? Sorry no idea how this works.ChirpyChicken said:Right so it's been allocated to the claimants court by mistake.

Could this be because I made a counter-claim?0 -
Xx is basically your local court.3

Nothing to do with any counterclaim - except that with a counterclaim, the CNBC send you the DQ but they tell you to return it to the allocated court (not to the CNBC like normal).1xvp1 said:

You get to choose your local court. Put your choice (local county court) on the N180.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

(9)The court will treat the views expressed by the parties as an important factor, but decisions on allocation and assignment are for the court, to be taken in the light of all the circumstances, and the court will not be bound by any agreement or common view of the parties.CPR PD 26.14(9) (I think)
