    I just browsed back and see you researched this already and you know: "The usual outcome, even when you win, is that you’ll recover your court fees, travel expenses, and lost earnings (capped at £95/day) – but not your general legal costs."

    And your defence included Hannah Robinson's case and the ban on the 5 minute rule. Excel have no hope whatsoever and they know full well there's no cause of action to sue over 5 minute rule cases.

    @Coupon-mad Thank you that gives me more gusto to power through. 100% I won’t drop and quite happy for a hearing, will use it as experience in case I ever get called as an expert witness to see what the court system is like.   I am quite tempted to answer to DCB legal and try to bamboozle them haha, if I’m in the mood I’ll let you know how it goes :smiley: 

    I said this to the mediator that the rules changed 17 Feb 25 and if a ticket is paid in full then grace periods should not be chased. I think it’s very silly they’re even pursuing what a waste of their time.  I assume they sit there working through lists of cases, it’s absolutely criminal how much money they make from scaremongering. Especially when there is absolutely no fault of the driver.

    Update, they’ve tried to call me again today call number 2. I’ve agreed to speak and have requested a call back lol. Just going to give them my opinion and stand point that no way I’m paying as I’ve done nothing wrong. Any advice on something to say for extra punch haha.

    Yep.

    The 5 minute rule was deemed to be in breach of consumer law (the CRA 2015) in Hannah Robinson's case, so the date the IPC banned it is irrelevant.

    The 5 minute rule was always illegal...end of.

    Thanks @Coupon-mad I will do. So funny they called and it was automated so then I requested a call back, then when they did I said I was in the middle of paying at the till in Asda so please call me in 10 minutes and she said okay and I never heard again 😂 until the next time 😬

    Please can you show a version which shows the court and Judge's name so that @Le_Kirk can include this in his judgments collection.

    Now it is a waiting game to see if the C complies or not. I think they probably will but the claim is doomed because it is manifestly unfair to apply the banned 5 minute rule.

    Just an update :) Had another email offer to settle last Friday and then a phone call today where they left a message to call them back. 

    I have attached a photo of the email they send for reference for anyone else going through this.  I have a sneaky suspicion that they won’t bother with the extra admin the judge has requested from them (that I mentioned on my last post), and that they’ll just keep hounding now until they drop it. Let’s see! Quite gutted I keep missing these desperate phone calls as I want to tell them no myself lol, however I can’t be bothered to reply to their silly emails so will just let those hang.  

    They’re on the ropes! I won’t give up until the end - court or no court I am here all the way.
