Yep, costs are not capped as it's not been allocated a track etc. But the judge isn't going to give you £1000 unfortunately 🙂
Also less chance of a hearing if you keep it reasonable.

Update, they’ve tried to call me again today call number 2. I’ve agreed to speak and have requested a call back lol. Just going to give them my opinion and stand point that no way I’m paying as I’ve done nothing wrong. Any advice on something to say for extra punch haha.

    Yep.

The 5 minute rule was deemed to be in breach of consumer law (the CRA 2015) in Hannah Robinson's case, so the date the IPC banned it is irrelevant.

The 5 minute rule was always illegal...end of.
Update everyone, received a general form of judgement order. Not sure if this is premature of me however I feel quite pleased with this. Am I right to be? :)

Just an update :) Had another email offer to settle last Friday and then a phone call today where they left a message to call them back.

I have attached a photo of the email they send for reference for anyone else going through this.  I have a sneaky suspicion that they won’t bother with the extra admin the judge has requested from them (that I mentioned on my last post), and that they’ll just keep hounding now until they drop it. Let’s see!

Quite gutted I keep missing these desperate phone calls as I want to tell them no myself lol, however I can’t be bothered to reply to their silly emails so will just let those hang.

They’re on the ropes! I won’t give up until the end - court or no court I am here all the way.

Great! Show us the NoD when it arrives ... not the email, the form please so we can count it!

They are scuppered as this is a 5 minute rule case. Unfair term under the CRA 2015.

    Hi Everyone,

Update - it has been struck out! Another win against the thieves of the private parking sector.

Please see attached court email response, thank you for the suggestion to contact the court directly otherwise who knows when they would have let me know.

Thank you all once again for the help and support in this matter, much appreciated and it has certainly given me confidence in the future with such a supportive forum to turn to!

Did you try to get costs?

The judges there sound like they might have granted them, but we get it if you ran out of steam after all this.

But I realise I never congratulated you:

    ANOTHER ONE BITES THE DUST!

Anyway, if you still have lingering anger about this scam and any time this weekend/next week:

FIGHTBACK ALERT - just days to go:

Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline next week. See this thread:

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-now-extended-closes-friday-26th-september/p1

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam over 18 million times per annum. Motorists need your voice added please.

    CLOSES ON FRIDAY 26th SEPTEMBER.
