Do have to reveal the identity of the driver at this point (I wasn't there) and do they become a witness themselves? I'd rather they didn't as it was my decision to pursue this so I don't want to drag them through it.
Do I have to include references to cases of precedent, as I feel a bit uncomfortable including legal references that I don't really understand, so can't back up.
Sorry to bombard with questions, but this really is the intimidating bit for me as I've been through nothing like it before.0 -
There is no law stating that you have to reveal who was driving, even if it wasn't you! Its entirely up to you what you write
Yes you add exhibits etc, as well as your Witness Statement, the newbies sticky thread in announcements gives examples or information on the WS bundle stage
Most victims have not been through it before, I definitely never have, so I would study other recent cases on here as well as following the advice in the newbies sticky thread, reading other cases assists everyone involved, it's valuable free sharing of ideas etc, which is what a forum is for
I strongly suggest that you edit the thread title to something more suitable like
I PARK , DCB LEGAL court claim 2025 , WS stage
Or something similar0 -
Title changed.
A lot of the WS examples refer to the Claimant's WS, but I haven't had that, should I have? Or will they deliberately wait until 14 days before the hearing? In which case should I still submit mine?1 -
They could send it at any point, sometimes it's in with your spam emails.
I received the WS in my case over 3 months before the hearing, however that was a multiple PCN claim2 -
This is the flaw in witness statements. You exchange them, so you can't respond to other side unless you receive it before 14 days. Sometimes they send a supplementary WS after the 14 days, but that just irritates judges.Yes you need to submit yours no matter what.2

Does that mean they are likely to just not pay the fee and it just fizzles out, or will I be officially notified either way?0 -
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
