    Does this all end if I pay as told and it will not affect my credit rating or anything like that? 
    Pay the Judgment total in full to Gladstones within the 30 days grace period allowed and the Judgment is expunged once they inform the court,  therefore no impact on your credit file 

    Your credit score by any company is irrelevant,  your credit file is what Matters

    the judge don’t agree that the POC were unclear 
    said he is not bound by court cases I attached and doesn’t think the signs were unclear even thought the claimant couldn’t prove where the signs were and where I was parked.  

    Also said it seems online copied defence and WS.   

    Told to pay the fine £280 - Gladstone solicitor did offer £60-80 before the hearing…….
    I am not a lawyer nor legally trained but to me the POC did not have a clear reason to bring the claim; "parked in breach of the terms" but doesn't state which terms and how you breached them!  Chan and Akande are both appeal cases and are persuasive on lower courts.  Looks like the judge did not take that into account.  Just because a defence is found on-line or has been used before, doesn't make it wrong!  If that were true no-one would ever have a defence as it had already been used.  Claimants would go out of business as they are very fond of template witness statements!  One judge, when faced with the "defendant has used a defence found on the internet", said "so what!"
  • The example the judge gave were laughable and not worthy of someone sitting on the chair as a judge. He said if you go to a cinema its common sense that you have to pay as soon as you are in the cinema whether you watch a movie or not - i was like if you were not in a position of power i would have given you such a reply that you would have regretted giving such examples.  overall very bad experience and i feel like i have been treated unfairly especially when he asked the claimant where the signs are and if they have any evidence to which they said no evidence. 


    I just feel like sometimes we emphasis on this form that we shouldnt talk to the claimant lawyers no matter what but it seems thats a bit harsh. The guy i met from the claimant side seemed genuine when he offered settlement.

    Judge bingo by the sound of it because Gladstones POC are exactly like the Chan and Akande cases. He's an idiot IMHO.

    Just to add, as it provides a level of revenge:

    If you want to be part of the push to change things in future, it's very important that people like you tell the Government NOW that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.

    b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND ENGINEERING A 'PAYMENT PLAN'. THIS PUT YOU OFF ENGAGING AND SO YOU DEFENDED IN COURT.

    c). Tell them about your experience.
