  • another question - help desk at court have confirmed they will accept email WS but do i do the same for the claimant? i have sent an email to Gladstones with a delivery and read request but should i send them hard copies too?

    You are citing Chan & Akande; does your defence also cite those two cases?  If so, your WS seems to be answering facts that you couldn't/shouldn't know if the POC were sparse.  You don't need to send hard copies as well as email providing you get a acknowledgment of email.

    3.2 Upon arrival, the parking area was heavily congested, with no readily available parking spaces
    and it was not my intention to park my car anyways.

    Just a couple of errors I found, check the rest of your WS for other typos/errors.

    No need for hard copies. Gladstones might not even send a rep to the hearing.

    Either way, your WS is good on the main point about lack of contract/signage and on the preliminary matter of striking out the claim.

    I think the judge will choose one or the other so that you will likely win. Attend the hearing with a crib sheet and access to their WS bundle and yours. Get there early to get through security. If they send a legal rep do not agree to talk to them about the case in the waiting area or side room. Nope!

    @le-kirk and Coupon Mad - thanks for your input above. 


    @Coupon-mad - i have been reading other threads and saw others being advised that you MUST email the PPC and DCB Ltd to tell them to erase the old address.  You cannot leave rogue parking firms and their scum DRAs with a choice of two addresses.


    Does this apply to every case where PCN was sent to wrong/old address?

    It cannot hurt to make sure everyone has your correct address - then they will now where to send the cheque when you win!  [I know we don't use cheques anymore, just a figure of speech.]

    Case lost 

    the judge don’t agree that the POC were unclear 
    said he is not bound by court cases I attached and doesn’t think the signs were unclear even thought the claimant couldn’t prove where the signs were and where I was parked.  

    Also said it seems online copied defence and WS.   

    Told to pay the fine £280 - Gladstone solicitor did offer £60-80 before the hearing…….

    Does this all end if I pay as told and it will not affect my credit rating or anything like that?
