If you found that defence by going through the Template Defence announcement, you will see there are TWO appeal judgments - see here 15 August 2024 at 9:33AM <<<LINK
Also, no evidence (photos) go with a defence, that comes later at witness statement stage.
  • Thanks for pointing this out @Le_Kirk

I will add the pictures of Charles Akande judgement too. Other than this - do you think everything else looks fine?

will not upload the evidence photos but only shared it here because they were relevant to Para 5 which is below  - i am not sure whether to include para 5 or not hence posted pics and want the advise of members here...

    5.    The Defendant denies liability for the claim in its entirety.  Given the prohibitive nature of most PCM signage seen in their other Gladstones !roboclaim' cases and the images seen on Google Streetview, the Defendant takes the point that the wording of the Claimant's signs typically forbids parking to make it worse, there were signs outside AirNation play area to say FREE Parking which caused confusion. As such, there is no offer to park and therefore no contract.  Accordingly, the Defendant denies that the vehicle was parked in breach of any term (whatever that term might have been) and denies that a contract with PCM to pay any sum that would have been agreed.

Yes include it all. Make Gladstones work to read a longer defence, why not?!

You have received a copy of the claimant's N180, you should wait for yours to come from CNBC or check your status on MCOL and when it shows DQ (N180) sent to defendant you can download one.
  • Hi all

This letter has now been received
I received  the claimant's N180 in a email (Gladstone Solicitor ) a couple of days before receiving this letter

Fine. You know that's normal as all this is in the first 12 steps.

Hopefully you are merely updating your thread with a document timeline because we aren't needed until WS stage. Much later.

Please can you edit your thread title and remove the word 'CCJ' (because this isn't one) and add the word Gladstones.  At the moment, everyone who sees your thread title thinks you are dealing with setting aside a CCJ.
