    Claimant offered a £50 discount on the penalty and the mediator suggested if I don’t accept then the claimant will see me in the court because they have a strong case and they believe the judge may side with them as they think they have sufficient evidence as per the law and I am at fault 

    I insisted I would rather pay the full amount than be intimidated by them.  Received an email straight away to say 

    Mediation Not Settled


    the claim will now be transferred out of our business centre to a court where standard directions will be given and you will be notified in writing of the next stages to follow.

    Just wanted to add - they argued that all my points on my defence points to a fault on my side and they have followed the correct protocol and procedures.   Signage and everything was is very clear at the premises where the ticket was issued etc. 

    and they also said I put the defence with the help of internet templates 😅

    You can say what you like at Mediation. The Judge doesn't hear about it.
    ........... and the mediator is not supposed to side with the claimant, they are supposed to remain neutral.  I suggest you report them to scmreferrals@justice.gov.uk

    She didn’t sound neutral at all and wanted me to remember the consequences if the judge decides against me 🥹

    Update - 

    I have now received a letter that says > This claim has been transferred to the County Court at Birmingham for allocation. this is around 1.5 months after the mediation call

    You can expect a hearing any time within the next 6 months

    Now received letter for court hearing for 2nd week of July.  Doubts starting to creep in now - thought it would have been struck off at this point 


    the main point they seems to have is that they sent letters to my old address for the PCN which I obviously didn’t receive and my driving licence details were only changed a lot later when I realised i was actually required to update them.
