Red light offence or overload car??

I was whit 4 costumers in my taxi and driving on 30 mph When i try to stop for red light my brake fail and i manage to stop after white line . I got flashed twice. I drive slow back behind the line and next day i had car checked and they find brake pads issue. My passengers admited they had gym weights on my trunk around 145 kg and whit their own weight was above 560 limit of the car.I didn’t know about this but this it’s different offence and its not necessary penalty points. What you think. I had everything on dash camera IQ 4k nextbase showing exactly my speed and how start slowing way before light

    Going through a red light is an absolute offence.
    If you want to bring that up you'll likely get done for both offences.

    If you were caught on camera, then the outcome will depend on how long the lights had been red. Thee offer of a course, a fixed penalty, or court .

    If you do find yourself in court, having defective brakes and/or an overloaded car is not a defence.

    No course for a red light offence.  Guaranteed points if found guilty. 


    With your recent NIP for 72 in a 50 limit.  Your insurance renewal is going to take a sizable hit.

    Garage find air in brake system and worn brake pads. If i understand right an malfunction of your car its your driving fault but in this case why we pay for mot ? (i got report and price to fix right now)

    An MOT can only assess the car as it's presented. The rest of the time it's for the driver to understand and check their vehicle. Did you not notice having to brake harder prior to this incident compared to before?
    Presuming you have an MOT every six months?

    No I didn't notice nothing unusual but the mecanic told me this can occur on heavy load . No one can notice something like this before. He agree to provide me a full report of incident. My speed on camera indicate start breaking way before starting from 30 mph .At whit line speed was 17 and car was fully stopped after line .

    So it looks like you've committed three offences but so far only been potentially caught for one. You probably want to keep it that way by not drawing attention to the others. Get your car fixed ASAP and make sure you check the weight of passengers' bags in future. Pay whatever penalty they give you and hope to avoid a ban.

    Not at all. You're a private hire driver which overloaded their vehicle. As such you couldn't stop in time for a red light.  Luckily it was just a red light and not someone which had run into the road.
    Outcome? 3 points and £100 fine. Unless you opt to goto court with your 'defence' in which it would probably see additional offences added.
