DCB Legal - Letter Of Claim :( AND now Court Claim!! :((

Your court order states that you are ordered to provide a WS, By the 14 day deadline, it's an order that you must comply with, unless they discontinue, you dont have a choice if the case proceeds to a hearing
You check with the court after the hearing fee deadline date to see if the fee was paid or if the case has been discontinued
If its paid, or if you have not received an N279 discontinuation document by email, you submit your WS to the court and also to the lawyers, because the court ordered it
You dont wait around for theirs because both sides have the same deadline, so worry about your participation, not theirs, but keep your eyes on the ball
The chances are that they will discontinue, in which case you won't need to follow the rest of the process2 -
1. No, you look at your Notice of Allocation and there will either be a date or it will say 14 days before hearing date. Your hearing date is on the NoA, so you can work out your deadline for the submission of WS.nomorecc said:
1. So then Should I file my WS in say a months time?Coupon-mad said:You won't get that; they'll discontinue
2. Not sure how I am going to defend it since I already said why I was parking there in my appeal.
2. Your WS backs up and support what you put in your defence NOT your appeal. Have we seen your defence, did you use the standard template?2 -
I have gone back through the thread and can see that you have correctly used the template defence with Chan & Akande, as no breach was pleaded. You need at least to tell you story of what happened on the day and add the Chan & Akande judgments (linked from the NEWBIE sticky). Examples for format and style are those by @aza123 which includes Chan & Akande. @Kpmp54 is recent & has Chan & Akande and also Smith, Edward & Wilkinson. You might also study those by @mtrolley123 and @maxim024 both have Mazur because your claim form was signed by Sarah Ensall who is not a solicitor2
