    I did get the automated response email after sending my questionnaire — is that the same as the auto-receipt you’re referring to, or is it a separate confirmation I should have received?

    This is all new to me so I just want to make sure I’m doing the right thing and receiving the correct information back.

    Hi guys,

    I received the below email response yesterday from the Direction Questionnaire Team (long email alert)

    I’ve emailed my defence and questionnaire as instructed so I’m unsure why my defence is suddenly removed from the record.

    Can someone please provide me with guidance to resolve this matter?


    Good afternoon,

     

    I am returning your response as your defence has been struck out (removed from the record). 

     

    What you can do if you have a judgment against you

    If you do owe the money, you’ll need to pay it back. If you cannot afford to, you can ask to:

    • Change the terms of (‘vary’) the judgment

    • Pay it back in instalments

    Find out what options you have for paying the judgment.

    You can apply for the judgment to be cancelled (or ‘set aside’) if:

    • You do not owe the money

    • You did not receive, or did not respond to, the original claim from the court saying you owed the money

    Steps to cancel or set aside:

     

    • Fill in an N244 Court Application Form completing sections 1,2,3,10 and 11.
    • In Section 3 you should ask for ‘Judgment to be Set Aside’ and give reasons why you don’t owe the money.
    • Email it to Applications.CNBC@justice.gov.uk
    • Pay the court fee by Credit/Debit card, by calling our Helpdesk number Mon - Fribetween 9am and 3:15pm. Court fees can found by clicking this link Civil court fees (EX50) - GOV.UK

     

    Please note, an application to set the Judgment aside is not automatically granted and the outcome of it, is the decision of a Deputy District Judge. You’ll have to go to a private hearing at the court to explain why you do not owe the money.

     

    Help with fees

    Log into https://www.gov.uk/get-help-with-court-fees 

    You will be given a Help with Fees, ‘HwF’ reference number which you need to clearly note on your application form.

    Thanks @coupon-mad I’ll put in a formal complaint.

    I have just phoned the direction questionaire team and they said my defence was struck off because I missed the deadline.

    They said that an initial questionaire was sent out in the post in June 25 which I didn’t receive (no proof was provided)

    Then the general form of judgment (final reminder) was sent in the post with a deadline of 11th Sep 25 but I didn’t receive this until the 12th Sep 25 which I filed instantly.

    Shall I send my formal complaint back to
     DQ.CNBC@justice.gov.uk or could you recommend another alternative email please that is specific for complaints only? 

    Would I still need to fill in the N244 Court Application Form to cancel or set a side a potential CCJ?

    I suggest that one thing you should do is complain online directly to hmcts, get them involved 

    Claim responses is one possibility at the CNBC,  not DQ, and claim progression too, or instead

    Hi guys,  

    I’ve drafted my compliant letter. Can you please let me know if anything requires tweaking?

    Subject: Formal Complaint – Defence Struck Out Due to Late / Unproven Service of Court Documents - 

    Dear HMCTS Complaints Team,

    I am writing to raise a formal complaint regarding the handling of my case documents, which has resulted in my defence being struck out unfairly.

    In June 2025, a Direction Questionnaire was allegedly issued to me by post. I never received this document, and I have been provided with no proof that it was ever sent.

    The General Form of Judgment or Order was allegedly sent via post with a deadline of 11 September 2025. However, I did not receive this document until 12 September 2025, after the deadline had already passed. Consequently, I had to locate my own copy of the Direction Questionnaire Form online, complete it, and email it to HMCTS on 12 September 2025.

    On 24 September 2025, I was sent an email from the HMCTS Directions Questionnaire Team which stated: “I am returning your response as your defence has been struck out (removed from the record).”

    On 26 September 2025, I telephoned HMCTS to resolve the matter and was informed by a member of staff that my defence had been struck out due to a missed direction questionaire deadline.

    As a direct result of these failings, I was deprived of the opportunity to comply with the court’s directions, and my defence has been struck out through no fault of my own.

    I believe this constitutes a serious procedural failure in the handling and service of court documents. I respectfully request:
    1. An urgent review of my case in light of the fact that key documents were not received, and no proof of service has been provided.
    2. That my defence be reinstated, as I was unfairly prevented from complying with the court’s requirements.
    3. Confirmation of the next steps I should take to ensure this matter is corrected.

    I trust HMCTS will treat this matter seriously, as the lack of proper service has placed me at a significant disadvantage and risks an unjust outcome.

    I look forward to your urgent response.
