Debt collector letters typically give 14 days to respond, genuine letter(s) of/before claim give 30 days.

Hi. After a while of silence a claims letter has arrived.

Could I confirm that the next step is an email to the debt collector in the letter, from post 2?

Your ref: xxxx - Proposed legal proceedings - Carparkers (Anglia) Limited

    Dear Sirs,

    Your ref: xxx
    Client ref: xxx
    Claimant: Carparkers (Anglia) Limited

    Proposed legal proceedings

I refer to your letter of claim dated xxx.

I confirm that my address for service for the time being is as follows, and any older address must be erased from your records and those of your client:

    Xxx

I am not returning your reply form or financial statement. I am under no obligation to disclose my financial circumstances in respect of a sum that is disputed.

The alleged 'debt' is disputed and any court proceedings will be vigorously defended. The vehicle was not parked; it was stopped briefly because a passenger, my son - then newly diagnosed with Type 1 diabetes - was suffering a hypoglycaemic episode requiring immediate treatment. Evidence of this was provided to your client at the appeal stage, so your client is already aware of the circumstances and has chosen to pursue the matter regardless.

I would further note that my son's condition is a disability for the purposes of the Equality Act 2010, and your client's continued pursuit of this matter, in full knowledge of the circumstances, should be considered in that light.

You should revert to your client. There is no prospect of voluntary payment in this case.

    Yours faithfully,

Looks OK to me, but do confirm the correct address for the service of papers too, as seen in the LoC response template in post 2 in the newbies sticky thread in announcements near the top of the forum

What do you mean by 'a claims letter'?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The "Letter before claim" - the guidance says to not ignore this one?

Email it to Oak legal, not any debt collectors, because you are now dealing with Oak Legal
