I cannot understand why people insist on putting so much irrelevant and unhelpful information into appeals or complaints.
The operator has jumped on the silly inclusion here that the driver was "dropping off scouts for a beach walk" why on earth was that gem of incriminating evidence given it need not have been in any statement at all!

But having said that the joint COP states in annex F1 Exempt circumstances:
    e) a vehicle that has been driven onto controlled land due to an emergency which could
not be avoided due to the exceptional nature of an incident outside of the control of the
    driver, e.g. serious illness;

In addition if the area involved was a no parking area anyway they cannot impose a charge for something they were not offering, no contract was offered.

I agree, had I found the forum or had any experience before submitting the appeal I wouldn't have included it.  As it is it's in the original appeal, not in the subsequent complaint.

What do I need to do next in order to handle this?

To whom did you complain, because that looks like a response either from or written by the unregulated private parking company? Did you complain to both the landowner and your MP? What did you state in the complaint?
I complained to Carparkers as it's the only complaints procedure I can find - I can't find any details on the landowner.

I wrote to my MP, but my MP is Kemi Badenoch and the last time she replied to anything was about a week after the last election was called...

Please use the side of a public road in future, not private property

NO.  If it is a medical emergency, pull in at the first place that is safe for the driver and passengers.

    Thank you :)
  • It seems there is a council car park with the same name further down, I assume you didn't park there?
You parked in the one next to https://www.beachrockbistro.co.uk and https://www.themermaidscatch.uk/ These have near identical website design so I would think the same company - I would start by asking these folk first.

I note they have their own car park in front of them, so it may not be the above, you could also try the Lifeboat tavern at the back as the land seems to wrap around the bistro too.

Weirdly, as I stated earlier it seems this is actually called Clink Road car park, the same as the council one, but not sure of the impact of this as I don't think this is council run, can't find an image of the sign inside anywhere...

One last try, I notice that this Airbnb (above the bistro / chip shop) has it's own private space within this car park - it 'may' be that they own the land too? (their pics can be found here https://www.airbnb.co.uk/rooms/44280606?source_impression_id=p3_1734690303_P36AT-mQvI1IlqU_&modal=PHOTO_TOUR_SCROLLABLE) worth a try?

If you mean this one, there are absolutely no signs that conform to any COP to make any contract. This place cropped up quite recently, with the next car park along:

Carparkers is a one man band which cropped up recently with an amateurish NTK.
In that case he stated that this an "offence" (an illegal act) which it isn't, and that is misrepresentation of authority.
He has very little in the bank for taking this much further, and he isn't that bright.
He was never going to accept any appeal anyway that's not profitable.
I would ignore it and come back in the unlikely event the idiot threatens court, you can ignore dibby debt collector letters though, as stated in the newbies thread.

Ah it's the one next to it, in the next post

That's the one!  I'll send an email to the airbnb people, see if they have a clue. Good spotting
