At the moment i'd say i meet (c) 20 to 50 metres 50% of the year and (e) some of the year with severe to moderate gout. I don't use an aid so i can't say (d). I've yet to see how osteoarthritis affects me over a longer period than 3 months but it's between (b) and (c) at the moment with stiff and painful (in activities) knee since September.

In 2021 when i made my previous PIP claim this (e) was around 40% of the year over the last few years but my eye condition affects had come down to around 30% of the year. The WCA tribunal calculated that i'm immobile 48% of the time and gave LCW (they just couldn't give me an extra 2%?) but the PIP tribunal didn't agree. I'll have to check what they calculated but i doubt it's anything near for WCA. Same DWP and same 2 medical reports but 2 different tribunal conclusions.

Again, please stop mixing WCA and PIP they are two different things.  In my time as a PIP assessor I never came across a percentage calculation .

Your eye condition will not normally affect your ability to walk, it is physically can you walk.  Youve said 40% of the year in 2021 and 50% at present this will not score you what you think as it has to be the majority of the time, which both 50 and 40% are not the majority of the time.  You are, in my view discrediting your own claim.  Even if they give you the benefit of the doubt and and score you B rather than A then you wont get a score that will award you Mobility in PIP.

    .
Right, so you've had a diagnosis of OA and decided that you should try again to claim PIP based purely on that diagnosis alone. Based on everything you've said in your last comment, I really can't see that you qualify. I'm sorry if this isn't what you want to hear but it's true.

Please leave out your last WCA because it's irrelevant.

Just rereading this, the highlighted shows the OPs difficulties with PIP.  Whats causing you to say you cant walk 20 -50 meters 50% of the time? It’s not your gout and not your OA? Your gout, as you have stated gives you (e) some of the time and your OA causes somewhere between (b) and (c).

You will destroy your claim if you keep harking back to what happened in the past especially with irrelavant matters (WCA). Many of us here sometimes have no idea what you're talking about so I assume someone testing your claim may be the same.

You best know how bad you pain is and how much you can walk/mobilise on the worst days so clearly write that down and then look at the descriptors. This should be very simple. Looking at others' experience would be helpful too.

A lower award would be fine and if your disability worsens you can revist the claim.

Keep things succinct or you will fail.

It's how you are most of the time. You can write about bad days but you can't just write about those.

Yes i know this, bad days have to be 51% or over.

In the last PIP assessment i was 51% and over with gout (7 months moderate over the year up to 50 metres with rest) and i keep saying the assessor made things up that i'd not said and extended the minority to mean majority. I can't empathise this enough.

For example, the assessor asked if i can shop at the supermarket, I said "yes, when i can walk without gout" which would mean on a good day. She wrote "he's ok shopping in the supermarket for more than half hour". She also wrote that i drop my young children to activities and back daily which i'd not said because my kids are over 20 when all i mentioned was that i do "school runs when i can on a good day".

To top it up and which i could never overcome, the judge said she doesn't believe me as credible.
