  • Just keeping you guys up to date.
Today I received a letter from dcbl (Debt collection bailiffs ltd)
    They have quoted
A Supreme Court ruling in November 2015 reinforced that it is lawful for a parking operator to pursue payment of a correctly issued unpaid parking charge through the county court. The case was an important test case for companies like our client. You can find further information online at
    https://www.supremecourt.uk/cases/docs/uksc-2013-0280-judgment.pdf

So I looked it up. Unless I’m wrong (and please feel free to check) this link goes nowhere.

So I guess now I just hold my nerve.

     Thanks

We all know about Beavis. Almost no parking case is the same as that one! So it's irrelevant.

    Do nothing.

By going confidently into the 'ignore' stance, the only steps to take are:

    - Tell them if you move house within 6 years.

    - Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread. Did you miss those pictures?

    - Come back if you get a LBC as per the 2nd post of the NEWBIES thread.  Probably from DCB Legal, whose claims are badly pleaded and they always discontinue.

Nobody pays a penny and no hearing is even needed in most cases. NO PAYING.

Search the forum and read a few cases as they are easy to beat by waiting for a claim form - it is easier than appealing!

There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs.

    Hello friends
it’s been January since I last wrote about this. During which I’ve had a dozen or so letters
i took the advice ignore ignore ignore
However now it’s got serious. I shall attempt to add pics of the letter rather than type it all out. But in a nutshell they say I HAVE to reply within 4 weeks or they will commence proceedings.
They’ve also enclosed a form for me to put down my monthly expenses and a press summary showing cases of Cavendish v El Makdessi AND Parking eye v Beavis dated from 4th Nov 2015
    Advice requested please.
     Thanks so much
I am attempting to find an “attach” button for the documents I photographed…
May need help with that too.

Sounds like it's a Letter of Claim,  if it is do not fill in forms,  just follow the LoC response advice in the newbies sticky thread in announcements,  in the second post

    Who is "they"  ?

Yeah, but I don't think you've quite got it: you actually want a court claim. That's when cases are won. No risk, no CCJ, no costs. Nothing.

We don't want to see a bog standard LBC please. So don't try to post it. And please stop mentioning the Beavis case like it's new or important. It's not.

You should be ready for this LBC. It's a standard stage. Just follow what the NEWBIES thread post 2 says (din't copy the template reply here please and don't post their template reply when it arrives because we've seen it all before).

This is a 'nothing' stage but there is a template reply already in the NEWBIES thread.

    Secondly, we need you!

If you want to be part of the push to change things in future, it's very important that people like you join us to reply to the new Public Consultation, to tell the Government NOW that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.

b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY A THUG THIRD PARTY DEMANDING MORE MONEY AND ENGINEERING A POINTLESS 'PAYMENT PLAN'.

c). Tell them about your experience and that your case proceeded to a claim precisely because (a) and (b) above mean there is no option, no safeguard for consumers EXCEPT court.

Responses are invited to the Consultation now:

Do it in August pleeease! We will discuss it all in more detail in the coming weeks on that thread.

In reply to Gr1pr the “they” I refer to are the company who sent the letter. They are saying I have 30 days to reply.
And in reply to Coupon mad so basically still ignore it and wait till it goes to court.
what does LBC mean ? I’m off to read newbie thread 2 now
Even though it’s getting a bit more serious now.
Plus are you asking me to write to the government or WAIT for this public consultation when it comes up (in August)
    thanks

Its clear to me that you were expected to actually name that company writing to you with that LBC / LOC

The newbies sticky thread doesn't tell you to ignore it either
