    So guys, the county court business centre have responded via email.

    They sent a response yesterday evening, around 6:38pm. Strangely, the first email they sent was followed up by another to state “CNBC would like to recall the message”

    Both emails have the attached, forms requested.

    Please see the attached the written response from them including the email they recalled that had a fee of £11 to be paid for a document they claim was already sent to me.

    As ever, advice and support will be very welcome.

    You don't want a copy of a document.

    Just do the N244 and witness statement as Dad, plus probably attach a draft defence because this will be a discretionary set aside under CPR 13.3.

    Thanks Coupon. I too thought the same about the document. I think because we asked where it was sent due to no previous correspondence.

    Has anyone filled in a N244 that I can see for reference?

    Sorry for the ignorance again, draft defence? What does that include and again is there an example?
    what does discretionary set aside CPR 13.3 mean?

    I have never done any of these things before and it is stressing me out.

    is there any support on how to fill in the N244 form? 
    Also do I need to complete the EX160 form at this stage too?

    CCJ set asides are covered in the NEWBIES FAQS thread. As is a Template Defence.

    The only difference in your Dad's case is the claim doesn't seem to have been sent to an old address, so he will have to rely on Civil Procedure Rule 13.3. Which is findable with a quick Google and has been covered a lot by @henrik777 (which the NEWBIES thread CCJ set aside section does already signpost people in your situation to read first).

    We know this is unknown and stressful and that you've not done this before but we need newbies to please read the NEWBIES resource thread first. That gives you the info you need then we help you do what's needed.

    Don't take long. Dad must 'act promptly' to set aside a CCJ.  The Judge will look at that.
