  • Thanks again @Fruitcake.  I'm learning fast about the "murky world of the unregulated private parking industry" and also about the general level of intelligence of those working for them.  So I suppose I shouldn't be surprised. I've got another recent spot, but I've had enough for today.....

  • I'm still preparing my complaint to VCS.  

    I’ve read the Service Agreement dated 4th October 2019 between VCS (the Company) and BAL (the Client) ( What is the current status of this document - I can’t even remember where in the threads I found it?).

    Section 3, The Company’s Rights and Obligations states :

    “3.2 The Company shall enforce the Parking Policy and Tailgating Policy detailed in Schedule One………and shall comply with…..the byelaws of Bristol Airport”

    Schedule One, point 7 states that a PCN will be issued for contraventions listed in the accompanying table, and that only those contraventions applicable shall be administered.  The only reference in the table to stopping is “CODE (46) STOPPING/WAITIING ON A ROADWAY WHERE STOPPING IS PROHIBITED”.  The Contravention on my PCN is “104) STOPPING TO PICK UP/ DROP OFF IN A RESTRICTED AREA”.

    It seems to me that VCS have issued a PCN without contractual agreement from BAL or OTPP.

    What do those more experienced think, please?

    The "stopping" was to comply with the red traffic light. That is not a breach of any airport bylaw. They are not chasing the driver under airport bylaws other wise they would have to issue a Penalty Notice and they are not contractually able to do so. They have issued a PCN under contract law but can only hold the driver liable. If they do not know the identity of the driver (unless the keeper tells them) they have nowhere to go.

    However, you are dealing with intellectually malnourished, ex-clamper scammers so don't expect that to stop them trying to intimidate you into paying. You must fight these vexatious scammers all the way. They would be exposing their intellectual malnourishment if they let this go all the way to a hearing. Let them waste their money of a claim, satisfied in the knowledge that it is going to cost them £x and you £0.

    Perhaps you could ring the person you spoke to previously who said emails would be answered, and ask if there has been any progress.

    So I've just received this letter from a debt collector. I'm tempted to respond on the basis that (1) there is no debt since the PCN is invalid and will be contested and (2) If the case is not subject to High Court or bailiff action (last para of their letter), why am I being pursued by Direct Collection Bailiffs, Ltd .  I realise that I probably won't get a response, but is it worth a letter to further support my defence when it gets to the next stage.
