Britannia Parking Logging In System - Advice needed!

I have received a “Parking Charge Notice – Notice to Keeper” from Britannia Parking and need some advice. 

The car park in question has a logging in system to register the Vehicle Registration Number which I duly did.  I also received an on-screen message to confirm the vehicle was successfully logged and didn’t think anymore of it until I received the PCN of course!  The machine does not have the capacity to print a confirmation receipt or send confirmation by SMS to a mobile device. 

The PCN also mentions the Protections of Freedoms Act 2012 Paragraph 9(2)(b) of Section 4 where I need to provide the drivers details. 

I am trying to get in touch with the owner of the property to ask if they would kindly contact Britannia to cancel the PCN but to be honest I don’t hold out much hope for this as I’m struggling to get hold of anyone with any authority to actually do it. 

My only other option is to appeal to Britannia Parking on the basis I did comply with validating the stay but their system is incapable of providing the driver sufficient proof that I did so.  I was going to state something like this: 

 

The driver of the vehicle states they validated the Vehicle Registration Number shortly after entering the car park on one of the 2 logging in screens installed in the building.  The driver stated the system showed an on-screen message to confirm the vehicle details were logged successfully and therefore believes they did comply with Britannia’s Car Park Terms and Conditions.  

The driver has also stated that the log in screens do not have the capability to print a receipt or forward an SMS message to a mobile device in order for the driver to check the details actually logged are correct and to also to provide as proof where there is a dispute such as this.  It is also well documented that there can be errors with a digital electronic system. 

In these circumstances the Parking Charge Notice is unfair and unjust on the basis that a driver is never provided with any form of confirmation that the car was logged correctly because Brittania’s system is incapable of doing so and therefore request the notice be cancelled.  The driver’s details will therefore not be divulged.  

 

Does this sound ok and do I need to add/amend anything?  Also, when should I make the appeal?  ASAP or leave to the last minute?

    Please read the Newbies/FAQ thread where your questions are answered. Under no circumstances reveal the identity of the driver. Any appeal is done as the keeper. Whilst the NtK may claim it is issued under PoFA, it must comply with all the requirements of the Act and many NtKs do not fully comply.

    You could show us a picture of both sides of the NtK with your personal detail, VRM and PCN number redacted. Leave all dates showing.

    What location/business were you patronising at the time? Fish out the CEO details and try emailing them. You need to start as high up the management food chain as possible with your complaint about the unfair invoice from their agent.

    I have started to read the Newbies/FAQ thread but I am finding it a bit overwhelming if I'm honest.  I'm dipping in and out every so often and some of it is starting to make sense!

    I have attached a copy of both sides of the NtK as you suggested.

    The location was a sports and social club and I was attending a weekly weight loss group.  Companies House show 2 directors listed so will try to get hold of their email addresses.  If not I will have no option but to write a letter.  I was considering handing it in but there's no guarantee it will get to the correct person.  Even sending it by Track and Trace won't guarantee this either will it?

    Just go in and verbally complain first. Go on a weekday if you can, and insist in speaking to the Manager.

    Tried that already and the manager wasn’t conveniently in.  I also asked the woman who does the weight loss group if she could help get me the contact details and when I chased her up about it yesterday was told that the car park was nothing to do with the club and I needed to take it up with the Parking Company.  By the sounds of it, that’s what she’s been told to say and I think this would also be the response if I can eventually get to speak to him.

    We can assure you that the person who signed the parking contract with Britannia for that site can cancel the PCN for you, as half of the 2 contracting parties, all you have to do is track them down and speak to them, plan A 

    We don't waste our time telling people this if it wasn't correct 

    Talking to acquaintances, underlings and people who aren't a party to the signed contract are strangers to that contract and generally don't have a clue 

    Its irrelevant what these third parties believe, you talk to the organ grinder and not the troupe of monkeys who are powerless and generally clueless too

    For some reason people are very sceptical of landowner complaint but it is 'PLAN A' because it WORKS!  Remember, we've been doing this for over a decade..

    Then the same posters who really really wanted to rush into a pointless and biased 'appeal' (and only complained to retailers because we insisted) come back telling us it's cancelled.

    Thanks Gr1pr.  I know you are all here giving us the correct advice and I wasn’t implying that you weren’t.  I really do appreciate all the comments that everyone has posted so far.    My point was just I am struggling to find contact details for the owner.  I will try phoning and going in again a few times to see if I can catch them.  My intention wasn’t to upset any of you.

    We understand your point, and we have seen the fob offs thousands of times over the years, seen it myself when advising family and friends, nevermind victims on forums  like yourself, so treat everything you are told with skepticism, ALWAYS trying to get to the correct and ONLY person with the actual power to cancel the PCN, as a co signer to the contract there

    But as coupon mad said above, once victims find the correct person and explain the problem, we see the PCNs cancelled time and again, I have been fobbed off by customer service people numerous times, but have always prevailed in the end by being forceful and getting the correct people involved , like this Aldi one below

    I was recently told on the phone by Sky customer service that they couldn't sort out my DD despite me pointing out their failings regarding incorrect spurious charges for leaving their broadband due to the recent hikes in charges, but told that it would sort itself out eventually ( whilst I was out of pocket. )

    A very strongly worded written complaint one late evening 2 weeks ago brought about responses within one hour that reversed the spurious charges and my account was now in credit, which the MySky app confirmed 

    Personally I believe that they should have refunded my bank account instead, but I decided to let it ride because my credit will pay for the TV bill for a few months, when the contract expires 

    I could list numerous other victories, including getting companies like Parking Eye to cancel family PCNs on retail parks , but plan A is always the first piece of advice given, no matter how hard it is to contact the person who signed up the contractor

    A quick Google search reveals a web page with a link to their FaceBook page. I would suggest starting there to find out who may be the person who runs the Social Club or may be able to point you to who owns the land. Also, advising all the other members of that group that they run the risk of a £100 invoice from an ex-clamper each time they visit may enthuse someone to get it cancelled in the interest of positive publicity rather than negative.

    I’m planning to go down there every day to see if someone will give me a telephone number or email address of the 2 directors listed on Companies House or better still catch one of them there so I can speak with them.

    I see there is an email address on the Facebook page you found so I’m going to try that when I’m happy I’ve included everything I want to on the complaint letter.

    I did look on their website but that was a waste of time.

    Will definitely speak to their patrons when I’m there to “warn them”.
