    A landowner or similar can usually request a cancellation at any time, even If there is a court claim in progress, its never too late.  Your appeal to the parking company doesn't change it, but don't miss that deadline

    Why do you think you must appeal?  In many cases with POFA NTKs it is best not to bother. Obviously I don't mean pay it!

    I thought as I was never intending to pay, I needed to appeal (which would then get rejected), then appeal to POPLA and if that got rejected then wait for the debt collection agency to make contact.  Advise them of the reason for non-payment and then sit tight.

    Obviously my ideal is to get the landowner to cancel the charge but although they say they're going to do this they've been dragging their heels a bit and therefore I wanted to cover all bases.

    I was going to appeal on non compliance of POFA on 9(2)a, 9(2)e and explain the driver did validate the vehicle (although there is no proof).

    I'm slightly confused as to what to do now as I have 2 experts telling me something different.  Could someone explain please.

    I have always followed that set of ideas and I personally won't change until the new DLUHC CoP kicks in, so my personal opinion is generally in agreement with your understanding. I believe that it is better to engage with the enemy at least once, or twice, in brief skirmishes, then settle back if it cannot be cancelled. The Idea is that by engaging at least once you cannot be accused of ignoring the paperwork, regardless of the outcome, so safe in the knowledge that you did what you could at the time 

    I appreciate that others have different views, but forums are about opinions, I respect the opinions of others, especially those of CM , who is highly respected and is working on the front line , but I don't answer for them or to them.  My opinions have been formed over the last decade of helping people, and I believe in appealing at least once, plan B , especially if plan A fails to produce, so for me it's plan A followed by plan B , even if it's ignore after that sequence 

    But never ignore a Letter of Claim , or a Court claim from the CNBC in Northampton 

    Frankly, I don't care if one person disagrees with me, or one hundred, they may have their own reasons, but I do agree with you on the way you explained it, because your way is also my way 

    However, I disagree with your statement about engaging with the debt collectors once, my advice is never contact the debt collectors, not at all , never, its the company that issues the LoC that you perform that action with , typically a legal firm

    I don't disagree.  Whatever the OP is comfortable with, is the answer (as long as they never pay!).

    I merely implying that, with a POFA worded NTK, it may be worth considering whether there is anything that POPLA will like about this case and if not, I wouldn't bother.

    That's how I put it to my relatives.  However there is no harm done if you want to spend hours appealing.

    I would like to thank those of you who have taken the time in the last couple of days to comment on my post from Monday.  It's given me lots to think about.

    I have decided (rightly or wrongly) that if Plan A doesn't work before the end of the week I will dispute the charge as I would with any other invoice/charge that I don't agree with.

    I'm not going to spend much time on the appeal - I'm just going to dispute the charge without naming the driver.

    There is absolutely no way I will be paying the charge btw!!!

    I'm really sorry if this is a stupid question but I just would like to check something.

    I believe Plan A has worked because when I login to Britannia Parking's website to see if I can still pay the PCN, all I get now is "Sorry, there was a problem obtaining these details - please click here to try again"

    This happened yesterday and I've just tried it again just to make sure their website was down and it says the same thing.

    The first appeal as you all mentioned failed so was given a POPLA code which still appears to be active. 

    I obviously don't want to be wasting my time going through the palava of completing that if I can help it especially if it has been cancelled.  I assume they don't bother to tell you.

    What is everyone's take on this?  

    Once again apologies if I'm stating the obvious!!
