Already spent more than 3 hours today, to read through stuff about WS and drafting, editing it... (goodness, so unfair that such scamming company can easily make it so that it would cost so much time and effort for their victims to defend themselves from nonsense accusations.)
Also, pretty unfair that in my case, they could wait until I prepared and sent the WS first (before 11 Feb), before deciding to pay the court fee (26 March) or just discontinue the case (in which, of course I know they will very likely discontinue it). This makes me have to spend hours to prepare the WS and documents, before they finally discontinuing it.
Anyhow, sorry for the blabbing... I got a few questions here, hope they dont sound too silly:
1. Should I use MS word to write the WS, and then just put everything in it, then save a pdf copy of the file when Im done, and email it to the Court and to CP PLUS LTD/DCBLegal? Which emails should I send to? The local court one and the general email of DCBLegal?
2. Exhibits <these are like reference files, yes? How do I attach them? Should I just paste them all at the front of the word file since they are images (like the Beavis case sign from google and the images of different cases)?
3. Since they didnt even mention what displayed terms and conditions I've breached, do I still need to include the photos of the signs from the car park in my case?
Images on google map is quite old, I'll have to go there in person to take some photos if thats the case.
4. I read different WS samples and people often put "My defence is repeated and I will say as follows", does that mean apart from the factual thing that Im going to mention, and a bit of wordings and conclusions being different, I shall make sure the rest is almost identical as my defence? Or shall I just put my defence is partially repeated??? (Since the WS I've read included a lot more cases.)
5. In my case I really dont know much to say, so just a really short story of what I did and what happened later would be enough?

It is Witness Statement (WS) time then,

have the latest WS examples that you can use for style and format help. A WS is "in support of my defence as already filed" and is a narrative of what happened on the day and subsequently. It is written in the First Person ("I") in your own words. It is also the opportunity to provide evidence in support of arguments you have used in your defence and in your WS. You don't need to reiterate anything that you put in your defence and you cannot add new defence points.2 -
Sorry to pipe in here - I too am at the early stages of this type of activity and will ask questions in another thread. Can I ask why you didn't just pay the £60 and be done with it?

Nobody should pay a private parking charge, all the time that the industry ducks regulation by squealing like pigs and throwing money (IMHO rinsed from duped victims) at it.

Hi, Ive been preparing the WS, and also asked a friend who had to pass through the retail park to take some photos.
First of all, I did not include so many cases in my defense before. Since we cant add new defence points, does that mean that I cannot include other cases? (Like, other "strike out" cases apart from the "Chan" one)
Secondly, The retail park seemed to have updated their parking signs recently, should I still include them? And should I mention this in my WS too? (I could only find a very unclear old signs on google map from Nov 2020, and below is the comparison between old and new sign, Im not even sure if either of them was the sign that was there when I went to the retail park back in Aug 2023.)
Thirdly, I still havent received their WS as of today, shall I mention this in my WS and said that I cannot respond to it in my WS?0 -

The difference in those signs is remarkably good evidence!

I can only say that both signs dont seem to have very big letters stating things in very clear way. Is that enough?
Shall I include the old low res car park sign photo in the WS???
The deadline for WS is 11th Feb, so more than a week later, but I aim to finish this and send it out in the next few days.
They dont have to pay the court fee until 26th March, so I assume they would wait till later to send me the discontinue notice?0
