    Please can I ask.  Claim issued 09/09, AoS submitted 22/09 - I think this means I have until 14/10 to file Defence.  Do you advise I wait until then to file, or can I get this out of the way early and file next week? Thanks in advance.

  • Sorry to ask - I've just got the N180 - one from CNBC and one from ParkingEye.  I think point 7 of the thread is saying to not complete the ParkingEye DQ.  But the N180 says to send copies to all parties?

    7. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.  YOU MAY HAVE TO WAIT TWO MONTHS OR SO FOR THE NEXT STEP TO HAPPEN:
    8. Wait for your own Directions Questionnaire from the CNBC and then complete it as described in post #2 of the NEWBIES thread.

    Isn't the DQ from ParkingEye a copy of their completed DQ that they have sent to the CNBC?
    If so, then --- " Nothing of interest there. Just file it."

    As instructed, you must send your completed DQ to the CNBC and send a copy of it to the Claimant.

    Regarding suitability for determination without a hearing - I have read the advice that I should be stating NO for this and the reasons being along the lines of a) only true witness b) litigant in person defendant against legally represented claimant.

    Can I ask, do you think this is a VITAL thing to not agree to, or more a "ideally" you want to be there to have your papers heard?  I will just really struggle with work and childcare to get a day off.  Just needing your expert advice - does it usually go badly for defendant if heard on papers only?

    You'll lose.  Think about it.
