You'd win. Jopson v Homeguard applies.  Search the forum or Google.

    DO NOT PAY ANYTHING.
    Hi,

Can you explain this in more detail, and maybe send me screenshots of parts that would confirm I'd win in court please?

    Thanks
No, you just need to read the NEWBIES thread.

    And Google Jopson v Homeguard.
Can someone help explain this? I honestly don't have the attention span/ADD to read through the whole Oxford County Court document..

    Thanks

Paragraphs 20 and 21 of Jopson give you the necessary information that an appeal judge gave that is persuasive on the lower courts should this ever be pursued that far.

Unfortunately, we cannot do everything for you. We try to point you in the right direction so that you can find the information you require. There are hundreds of requests a day on here for assistance and advice. If you need more help in doing this, perhaps find someone that can assist you to do this.

I read it all and I think I'd do pretty good in court considering I obviously wasn't parking there. I uploaded the proof I was doing a delivery with the phone screen of the delivery app to POPLA, I've since lost that picture or just deleted it. Is it possible to reread my appeal and find this picture, if this goes to court? I'll need that picture if this goes to court. Do you think I should let this go to court? I can't get a new screenshot, since amazon flex have since terminated my account...

The fine currently with groupnexus is £170. If this goes to court, and should I lose, how much would I end up paying altogether?

    Hi,

Should I lose, how much would i end up paying altogether with court costs and the increase PCN fine? I'm tempted to take it to court.

Its typically around £220 , or somewhere between £185 and £250 , providing that the spurious charges are thrown out in court, which they usually are, if it got that far, but many are discontinued before reaching the civil court, court is not inevitable

These are not fines, magistrates issue fines for various transgressions , PCNs dont increase, the charge is on the PCN and does not change, its fixed at the rate shown on the PCN

You can look on MCOL for various aspects, but the typical breakdown for one PCN is

The PCN charge itself, typically £100 but may be less, shown on the signs and the postal pcn
The filing fee, typically £35 unless its changed recently
£50 in legal fees, if incurred, typically by using a 3rd party lawyer firm
The court hearing fee, which I believe may be £25 unless it's changed recently

Or take our word for it, or look at any cases that lost within the last year

The average total cost if you lose was £212 , but its up to the judge on the day

The NEWBIES thread tells you that you'd only pay c£200 if you lost.  We do this all the time.

Email info@popla.co.uk and ask for all your data held under appeal ref xxxxxxxxxxx, including the appeal and attachments you sent to POPLA and the evidence pack from the parking firm.

£200 court costs? Or £200 including the £170 increased PCN fine?
