    Its possible that Savills are the retail park management company 

    Aviva Investors and Welbeck CP have been mentioned in a Google search, plus information in this link too

    Spending a bit more time this evening digging around, i think you are correct with Welbeck CP. They have a number of companies each seemingly named after the location of their properties. 'Welbeck CP (Haven Road) Ltd' seems to be the 'Haven banks in Exeter'. There are a few planning and study reports on the web suggesting redevelopment. I have checked the plans and it is the same location as the current car park. I will be emailing them (info@welbeckcp.com).

    I will post any news on a reply - if they even bother, in hope it will help someone else and save a bit of time.

    I received this today from my Smart Parking Complaint i submitted on 29/04.

    I definately didnt recieve an email from them. I have checked my deleted, deleted items and searched my entire mailbox, plus i was looking out for a response.

    I am unsure how to proceed.

    So do what they say, ensuring that you give the BPA AOS compliance team the response, as mentioned above, plus carry on with the complaint to the landowner and managing agent too

    You've seen all the other cases like yours?

    Tell the BPA this is an established pattern of what looks like sharp practice, and that you are the 14th person on this MSE list (give the BPA the link below):

    Tell the BPA that Coupon-mad will get personally involved in this issue and she will share the 14 or more cases as 'case studies' with the DLUHC next week, if the BPA fail to deal with this properly and stop just believing Smart/DR Plus about what looks like phantom rejection emails.

    This is so fishy it's a fish shop. If it looks like a duck and quacks like a duck...

    Show the BPA this post from me as well.

    I want them to kindly sort it out like Steve Clark did with Smart when a similar 'premature debt letter' pattern had emerged (from the SAME two companies) a couple of years ago.  It looks to me like Smart or DR Plus might be taking advantage of more credulous BPA staff after Steve left.

    You should respond to (not so) Smart Parking with a demand that they provide you with a copy of the actual email to include ALL headers that show it "was successfully delivered after being sent".

    Unless they provide this evidence, they are being mendacious. If necessary, SAR it.

    Thank, i have responded to Smart asking for proof with the email headers under a SAR.

    Lets see what happens this week.

    I have submitted a follow up complaint to the BPA mentioning my inital complaint and all the detail in your post. (including links to the 14+ similar cases and this specific thread).

    Massive Thanks for your support Coupon-mad, lets help it gets this resolved.

    I have also sent a chaser email to who i believe are the land owners, as i have not had a reply either.

    I'll post back when i hear anything.

    Please earn yourself £60 and help regulate the parking industry.  This is an official thing and MSE Towers has agreed I can share it...

    Short notice but do the survey now (and then a short & friendly video call next week) to tell the Government's consultancy outsourced firm your experience of 'appealing' and NOT GETTING A REJECTION LETTER OR ACCESS TO POPLA, WHICH IS A PATTERN WITH SMART PARKING THIS YEAR:

    URGENT - help us push the regulation of the parking industry and new appeals service over the line.

    There should be appeal (ADR) available at ALL stages to keep cases out of court.

    There should be proof of emailing rejection letters.  Not just 'here's one we drafted earlier...'

    Your experience would be useful for the research. 


    I will be v grateful if people pleeease take part in the research if you have tried to appeal, gave up because appealing was too hard or you missed a deadline (AS IN YOUR CASE) or from those reading this who have ever used POPLA or the IAS.

    The work to finally regulate this rogue industry is nearly there, trust me.

    This research needs responses from real people.

    09/5 - Smart parking DPO team emailed me for proof of address to validate my identity to respond to the SAR.
    14/5 - I replied with proof of ID

    They now have 28 days from 14/5 to produce the proof of the email being sent on 01/03/24.

    I will diarise 11/06/24 to start chasing.

    Thanks, I have signed up to the survey too. Still heard nothing about the appeal outcome, I am starting to think they are not going to reply and pass it on to the debt collectors.

    Is my best bet to email them asking appeal outcome, and when they potentially do the same as they did to @devonbay1234, I do SAR etc.?
