@agentfourty7 - I received a response from the SAR and didn't any other way. So maybe worth a try.

@Coupon-mad - I received my SAR request back today. A zip file with some documents, one of which was a screen shot from what looks like an internal system named 'Proof of appeal emailed.png' (see below).

This is very strange, and doesn't prove anything was sent or delivered to my email address.

I have emailed the DPO back asking for actual emails with headers from their email server.



Let me know if you have any comments on this. It all seems quite strange, especially as i would have just paid the £20 and it would have been resolved, its almost like they never wanted me to pay the £20 or have a chance to accept the appeal offer...

If you've asked for the original emails, including the headers, then they are required to provide those. What they have provided is not proof of anything.

The "sent" email includes something like this in the header with the all important date and time of sending:

Wonder why it has 'status: closed' bottom left?

OK, so i have just looked at my complaints logged with BPA and both have been closed?? 

I received no emails from BPA with any explanation on why these have been closed / cancelled

BPA-052530 - Original complaint to BPA stating i had not received a reply from my appeal to Smart Parking
BPA-052706 - Follow up complaint referencing to the initial complaint with mention to Coupon-mad and the 14+ additional cases like this.

I have also just tried calling BPA 01444 447300, but its just an automated message which is no help.




OK, so summarise.....

- Landowner : 3 emails sent asking for cancelation - no reply/acknowledgment (i have even emailed the bowling alley that pay rent there, they replied promptly and apologised for not being able to help.

- BPA : 2 complaints logged, both closed, no communication back (see above)

- Smart Parking : Appeal logged, no reply, SAR requested, replied without evidence of email on 01/03/24, x2 Debt Recovery Plus letters sent to me threatening court or pay £160

None of the above have any phone numbers for anyone to talk to any real people....

This is starting to stress me out now. Its affecting my mental health.

Where do i go from here?

Most recent reply from Smart Parking DPO. I have emailed back stating i have already checked my junk and deleted items for the last 3 months and have nothing from Smart Parking.

There is a info@ address there, i am not sure if this goes to a dead mailbox?

It's a fob off. If they are unable to forward a copy of the original email then they have not proven that they sent the email. They are required to provide strict proof and they haven't. End of.

Their internal systems are their problem not yours , computer says no , is no excuse for not retaining all your data including responses via email. ( Their outbound emails should be there in the outbox , like mine are, like everybodys are in this digital age, I have eBay and PayPal and banking emails going back years , plus emails to family and friends etc . )

The fact that the information is not there should be a matter for the ICO, once other avenues are exhausted , you should suggest that they look again, or issue a deadlock letter, or report themselves to the ICO for breaching the data rules regarding retaining important subject data. )

Jason Beer KC would have a field day with them. !

Anyone can find a sent email, never mind their 'internal systems'. They still used email so there will be a 'sent items' list.  They are playing you.
